CHAPTER 348
An Act for the relief of Truman H. Stewart and Mrs. Truman H. Stil oat
H 28]
Approved April 2, 1954
Whereas, William Kenneth Stewart, the fifteen year old son of Tru-
man H. Stewart of Keokee, Virginia, while attending high school on
November seventeen, nineteen hundred fifty-two, left such high school
for the purpose of fighting fires, this being done at the request of George
T. Bailey, the Lee County Forest Warden; and
Whereas, William Kenneth Stewart while fighting a forest fire under
the supervision of George T. Bailey was negligently permitted by the
latter to become surrounded by the forest fire; and
Whereas, William Kenneth Stewart died as a result of burns suffered
through the negligence of George T. Bailey, and Truman H. Stewart,
father of the deceased, has no remedy at law or in equity to recover
damages suffered through the negligence of George T. Bailey, since the
Workmen’s Compensation Law does not cover this situation and there is
. auier provision of law designed to meet such circumstances; now,
therefore,
Be it enacted by the General Assembly of Virginia:
1. There is hereby appropriated from the general fund of the State
Treasury, not otherwise appropriated, the sum of six thousand dollars
to be paid Mr. Truman H. Stewart and Mrs. Truman H. Stewart, equally,
father and mother of William Kenneth Stewart, deceased, by check issued
by the State Treasurer in accordance with a warrant drawn by the
Comptroller as provided by law.
