CHAPTER 5

An Act to amend and reenact § 3-117.25 of the Code of Virginia, relating
to penalties for deficiencies in connection with sales of fertilizer.

Be it enacted by the General Assembly of Virginia:

1. That § 3-117.25 of the Code of Virginia be amended and reenacted
as follows:

§ 3-117.25. Deficiencies or excesses in any other constituent or con-
stituents not otherwise covered by this chapter, which the registrant is
required to or may guarantee, shall be evaluated by the Commissioner
and penalties therefor shall be prescribed by the Commissioner with the
approval of the Board; provided, however, that in no case shall the pen-
alties exceed the commercial value of the fertilizer.

An emergency exists and this act is in force from its passage.
