CHAPTER 4
An Act to amend Chapter 42, as amended, of the Acts of Assembly of
1901-02, approved December 21, 1901, which provided a charter for
the town of Fries, by adding a section numbered 15, providing for the
issuance of bonds for school buildings under certain conditions.

Be it enacted by the General Assembly of Virginia:
1. That Chapter 42, as amended, of the Acts of Assembly of 1901-02,
approved December 21, 1901, be amended by adding a section numbered
15 as follows:
§ 15. Notwithstanding any other provisions contained in this charter,
the council may, upon two-thirds vote of all of the members of the council
and without reference thereof to the vote of the people, cause to be issued
bonds, or other evidence of indebtedness, in the name of the town, in a
total sum not to exceed the limit prescribed by the Constitution and laws
of the Commonwealth of Virginia, solely for the purpose of the construc-
tion or reconstruction of public school buildings within the corporate
limits of the town. Provided, however, that the council shall so authorize
the issuance of such bonds, or other evidence of indebtedness, only after
the council shall have, by two-thirds vote of all of the members of the
council, adopt a resolution to the effect that an emergency does exist in
regard to the school facilities available within the corporate limits of the
town; that in no event shall the council adopt any ordinance, or resolution
having the effect of an ordinance, authorizing the issuance of such bonds,
or other evidence of indebtedness, until twenty days shall have elapsed
after the adoption of such resolution declaring that such emergency does
exist; that such ordinance, or resolution having the effect of an ordinance,
authorizing the issuance of such bonds, or other evidence of indebtedness,
shall be adopted by the council at a special meeting of the mayor and coun-
cil called for such purpose and a copy of the proposed ordinance, or resolu-
tion having the effect of an ordinance, shall be furnished to the mayor
and each member of the council ten days prior to such special meeting;
and that the council shall not adopt any such ordinance, or any such
resolution having the effect of an ordinance, on or after the thirty-first day
of August, nineteen hundred fifty-four, and the powers herein contained
shall cease to exist and terminate as of such date.
2. An emergency exists and this act is in force from its passage.
