CHAPTER 30
An Act to validate, ratify and confirm under certain conditions the actions
of certain county governing bodies to discontinue and declare aban-
doned certain highways and streets and rights thereunder, notwith-
standing certain defects in such actions.

Be it enacted by the General Assembly of Virginia:
1. The action of any county governing body, completed prior to July one,
nineteen hundred fifty-one, purporting to discontinue and declare aban-
doned any highway or street not a part of the primary or secondary
systems of highways, based upon procedure which conformed substantially
to the provisions of Article 6.3 of Chapter 1 of Title 33 of the Code of
Virginia, and all rights thereunder acquired, are hereby validated, ratified
and confirmed, notwithstanding any lack of compliance with the provisions
of such Article 6.3 relating to notice and hearing, and notwithstanding
the order of the governing body purported to be issued pursuant to the
provisions of §§ 338-156 to 33-158, inclusive, of the Code of Virginia;
provided, any such highway or street had never been opened to or used
by the public; provided, further, that all owners of property abutting on
such highway:-or street assented in writing to the closing of any such
highway or street; and provided finally that such county has been termi-
nated as a political subdivision.
2. An emergency exists and this act is in force from its passage.
