CHAPTER 94
An Act to amend and reenact §§ 6 and 9 of Chap 44 of the Acts of
Assembly of 1988, approved March 1, 1988, being the charter of the
town of Clarksville, the sections relating to the appointment, terms
of office, compensation, powers and duties of certain town officers and
employees, and to the duties and powers of the mayor and of the
justice of the peace.

Be it enacted by the General Assembly of Virginia:
1. That §§ 6 and 9 of Chap 44 of the Acts of Assembly of 1938,
approved March 1, 1938, be amended and reenacted as follows:
§ 6. The council of said town shall appoint or cause to be appointed
a town treasurer and clerk (the treasurer and clerk to be one and the
same person if said council should so elect), and a town policeman or
policemen, and a town justice of the peace, which treasurer, clerk and
policeman or policemen and justice of the peace shall hold office during
the pleasure of the council *. The compensation of the policeman or
policemen, the treasurer and the clerk shall be fixed by the said council
preceding the appointment and shall not be increased or diminished during
the term for which they shall have been appointed or elected. The com-
pensation of the justice of the peace shall be the same fees as fixed by
statute for a justice of the peace for the county. Any town treasurer, clerk,
* policeman or justice of the peace may at any time be removed from
office by a majority vote of the council. Upon the death, removal or
resignation of any such town employees, the council shall appoint or
cause to be appointed a successor who shall likewise hold office during the
pleasure of the council. The council shall designate a chief of police officer
for oi town whose powers and duties as such shall be defined by the
council.
§ 9. The mayor shall be the chief executive officer of the town. He
shall take care that the by-laws, ordinances, acts and resolutions of the
council are faithfully executed. He shall be ex officio, a conservator of
the peace within the town and within one mile of the corporate limits
thereof, and shall exercise all the powers, civil and criminal, vested in
justices of the peace for the county.
The justice of the peace for the town shall be a conservator of the
peace for the town, and within one mile of its corporate limits, he shall
be vested with the jurisdiction, concurrent with the mayor, vice-mayor,
or acting mayor to issue warrants for violations of town ordinances, acts
and resolutions; admit accused persons to bond, and fix the amount
thereof, or remand them to jail pending trial, and shall be vested with
all the jurisdiction or authority within the town, and within one mile of
ats corporate limits, under the ordinances, acts and resolutions of the town
council, with which justices of the peace for the county are vested under
the laws of the Commonwealth of Virginia.
