An Act to amend and reenact §§ 28-88 and 28-89 of the Code of Virginia,
relating to collection of sums for licenses, rentals, and fines due
Commission of Fisheries; and the venue for certain trials. rH 218]

Be it enacted by the General Assembly of Virginia:
1. That §§ 28-38 and 28-39 of the Code of Virginia be amended and
reenacted as follows:
§ 28-38. Collection of licenses, rentals, fines, etec-—* No inspector
shall collect * any fines due the Commission. * Any fines assessed * for
violations of the shellfish or fish laws in any of the waters of the State or
in any of the waters under the jurisdiction of the State * shall be collected
as are other fines. When the lessee of oyster-planting ground remains
in default until December sixth of each year in the payment of his annual
rental, or any part thereof, the * Commission shall have the additional
power to remove and sell a sufficient quantity of shellfish from the leased
ground to satisfy such rentals or taxes, and all expenses incurred in
removing or selling the same. The sale of such shellfish shall be made at
public auction, any surplus remaining from the proceeds of the sale of
either bottoms or shellfish to be paid to the lessee.
The Commission may designate such trustworthy persons in the sev-
eral districts to sell licenses, and collect rentals and other sums due it, as it
deems circumstances require; all such persons shall be bonded in such
sum as will protect the Commission from any loss. All provisions applic-
able to such sales and collections by inspectors shall apply to such officers
and agents.
§ 28-39. Each inspector, agent or officer shall collect the following
fees for services herein enumerated in the issuance of licenses: One dollar
for assigning oyster-planting grounds; two dollars for assigning of bathing
grounds; fifty cents for issuing permits to buyers of seed, shucking, or
barrel oysters, to shucking house or to clam dealers; two dollars for
making sale where there is a default in ground rent, and such other fees
as are specified under other sections of this title pertaining to fish, crabs,
clams and other shellfish.
