An Act to provide for the use of streams and low lands obstructed by
newly constructed highways as fish ponds or water storage areas
under certain conditions and circumstances. 9

Be it enacted by the General Assembly of Virginia:
1. Whenever any highway is being constructed and the highway is to
pass over any stream or low land the obstruction of which is necessary
to such construction or if the present highway construction can be utilized
to provide a suitable dam for a fish pond or water storage area, then upon
application of the adjacent property owner requesting that it be so used,
the State Highway Commission may permit such use, provided that such
dam shall be subject to the provisions of Article 8 of Chapter 1, Title 33,
of the Code of Virginia, and any additional cost incurred thereby shall be
borne by such property owner.
