An Act to amend the Code of Virginia by adding thereto sections num-
bered 54-868.1 through 54-868.4, providing for injunctive relief in
case of certain violations of the statutes of this State; through the
procedure therein; and requiring certain reports. nH

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding thereto sections
numbered 54-868.1 through 54-868.4, as follows:
§ 54-868.1. Any person violating any statute which the Department
is empowered to enforce may be enjoined as to future violation thereof
as in §§ 54-868.1 through 54-868.4 provided.
§ 54-868.2. The courts of record of this Commonwealth having gen-
eral equity jurisdiction are hereby invested with jurisdiction and power
to enjoin any person theretofore convicted of violating any statute per-
taining to those boards and commissions set forth in Section 54-864, as
amended, from any future violation thereof. Such proceedings shall be
begun by the Director in the name of the board or commission affected in
the county or city in which the alleged unlawful practice occurred or in
which the defendant resides.
§ 54-868.3. Such injunctive proceedings shall not be instituted until
after the person proceeded against has been convicted of the unlawful
act concerning which complaint is made, nor shall any injunction issue
until after final hearing on the merits of the case. If upon final hearing
it is shown that the defendant has violated the statute which the Depart-
ment is empowered to enforce the court may perpetually enjoin him from
committing any future violation thereof. The practice and procedure in
such cases shall be the same, as near as may be, to that in any other
injunction suit. The remedy by injunction herein given is in addition to
the criminal prosecution and punishment provided for.
§ 54-868.4 It shall be the duty of the clerk of the circuit or cor-
poration court wherein any conviction is had of a violation of any statute
which the Department is empowered to enforce or any injunction awarded
under §§ 54-868.1 to 54-868.4, inclusive, to report the same to the Depart-
ment, which shall thereupon annul any certificate or license held by the
person so convicted or enjoined.
