CHAPTER 235
An Act to amend and reenact § 19-164 of the Code of Virginia, relating
to the tume of trial to prohibit trial at certain times except under
certain conditions.

Be it enacted by the General Assembly of Virginia:
1. That § 19-164 of the Code of Virginia be amended and reenacted
as follows:
§ 19-164. When an indictment is found against a person for felony
or when an appeal has been perfected from the conviction of a misde-
meanor, the accused, if in custody, or if he appear according to his re-
cognizance, shall, unless good cause be shown for a continuance, be tried
or arraigned and tried at the same term; provided that no trial shall be
had on the first day of the term unless it be with the consent of the attor-
ney for the Commonwealth and the accused, or his attorney.
