CHAPTER 124

An Act to amend and reenact § 33-76.5, as amended, of the Code of Vir-
ginia, relating to alternative procedure for abandonment of roads in
the State Highway System.

Be it enacted by the General Assembly of Virginia:

1. That § 33-76.5, as amended, of the Code of Virginia be amended and
reenacted as follows:

§ 33-76.5. Alternative procedure for abandonment of old road to
extent of alteration.—When any road in the State Highway System or any
road in the State Highway System containing a railway-highway grade
crossing, has been or is altered and a new road, which serves the same
citizens as the old road, is constructed in lieu thereof and approved by the
State Highway Commissioner, the old road and/or the public crossing may
be abandoned to the extent of such alteration, but no further, by a resolu-
tion of the State Highway Commission declaring the old road and/or the
public crossing abandoned * * *.
