Chap. 97.—An AOT to Amend and Re-enact Section 33 of Chapter 162
of the Code of 1860, and Section 10 of Chapter 208 of said Vode, as
dmended by an Act in force February Ist, 1872, in Relation to the Pay
of Jurors.
In force February 21, 1878.
1. Be it enacted by the general assembly of Virginia, That
section thirty-three of chapter one hundred and sixty-two, and
section ten of chapter two hundred and eight of the Code of
Virginia (edition of eighteen hundred and sixty), as amended
by an act in force February Ist, 1872, be amended and re.
enacted so as to read as follows:
§ 33. It shall be the duty of such clerk, as soon as practi-
‘eable after the adjournment of the court, to transmit to the
auditor of public accounts certified copies of all orders under
the next preceding section, making allowances against the com-
monwealth; and also to deliver to each juror a certified copy
of any such order, making an allowance to him, payable by
the commonwealth, and a like copy of any such order, making
an allowance to him, payable by the county or corporation ;
and the treasurer of such county or corporation shall, upon
demand, pay to such juror the amount allowed him, which
shall be repaid to the said treasurer out of the public treasury,
or out of the county or corporation levy, as the case may be,
upon the production of satisfactory proof that the same has
actually been paid by him.
§ 10. In a criminal case in a circuit court, if qualified jurors,
not exempt from serving, cannot be conveniently found in the
county or corporation in which the trial is to be, the court
may cause sO many a8 may be necessary of such jurors to be
summoned from any other county or corporation by the sheriff
or sergeant thereof, or by its own officer. Every juror so
summoned shall be paid one dollar for each day he attends,
and the same mileage as a witness in a civil case; and every
juror residing in such county or corporation, and serving on
such jury, shall be paid in like manner one dollar for each day
he attends on such jury. Such jurors shall be forthwith paid
by the treasurer of the last named county or corporation, and
he shall be repaid out of the treasury on the order of the
court.
2. This act shall be in force from its passage. —
