1. Be it enacted by the general assembly of Virginia, That.
sections first and third of chapter three hundred and forty,
acts of eighteen hundred and seventy-one and eighteen hun-
dred and seventy-two, be amended and re-enacted so as to read
as follows:
§ 1. That Roanoke creek, from Little Roanoke bridge to its
mouth; Ward's Fork creek, from Franklin’s mill to its mouth;:
and Cub creek, from Harvie's bridge to its mouth, all in the
county of Charlotte, shall be considered and are hereby de-
clared to be highways, and shall be subject to all the provisions.
of law in reference to public roads, now in force and applicable
thereto, except as hereinafter provided.
§ 3. It shall be the duty of the county court of Charlotte
county to appoint a commissioner, who shall assess the value
of the flat lands lying on the said creeks between the points
designated in the first section of this act, and annually estimate
and assess the benefit which shall accrue to the flat lands of
the contiguous landholders between the points mentioned in
the first section, and above, when the lands above will receive
benefit by keeping the creeks cleared out and free from ob-
structions; and the owners of said lands shall, each year, be:
assessed pro rata on said estimate, for a sum sufficient in the.
agoregate to meet all the expense necessary to keep said
several creeks on which their lands lie cleared out and free.

board of supervisors of Charlotte county, at their annual De-
cember meeting, or as soon as practicable after receiving the
report of said commissioner, and shall be collected by the said
overseers in the same way that the road taxes are now col
lected; and the land owners shall have the privilege of furnish.

in the case of roads.
2. This act shall be in force from and after its passage,
