AN ACT to amend and reenact § 61 of Title 4 of the Code of Vir-
ginia of 1950, so as to prohibit the possession of alcoholic
beverages upon premises operating as restaurants as de-
fined in §899 of Title 58 of the Code of Virginia of 1950;
and to prescribe the punishment for the violation of this
section.

Be it enacted by the General Assembly of Virginia:
1. That § 61 of Title 4 of the Code of Virginia of 1950 be
amended and reenacted as follows:
§ 4-61. Possession without license to sell alcoholic bever-
ages upon premises operating as restaurants as defined in Title
58 § 899.—No alcoholic beverages shall be kept or allowed to be
kept upon any premises or upon the person of any proprietor or
person employed upon the premises operating * asa restaurant as
defined in Title 58 § 899 of the Code of Virginia of 1950, except
such alcoholic beverages as such person owning or operating
such place of business is authorized by license under this chapter
to sell at such place of business; provided, however, that the
restrictions in this regulation shall not apply to any residence as
defined in subsection (21) of § 4-2.
Any person convicted of a violation of the provisions of
this section shall be guilty of a misdemeanor and punished as
provided in § 4-92.
