Chap. 377. —An ACT Providing for Working and Keeping in Proper
Repair the Roads of Fauquier County.
In force April 2, 1873.
1. Be it enacted by the general assembly, That it shall be
lawful for the board of supervisors of the county of Fauquier,
or the township board of any one of the townships of the said
county, in lieu of the system now authorized by law for repair-
ing and keeping public roads in order, to advertise annually
that they will, on a specified day, receive proposals for keep-
ing the roads in any particular road district, or a road, or roads
in each road district in any township of said county in repair,
in the manner to be specified in their stipulations. Upon the
receipt of such proposals, they are hereby authorized to accept
the bid which they deem best for the interest of the people.
The said township board may thereupon enter into contract
with the party or parties whose proposal may be accepted, to
execute the work according to agreement, requiring the proper
bond and security for the faithful performance of the stipula-
tions. Butin no contract for any year shall any township
board of any one of the townships of said county levy more
than ten cents (10 cts.) on the one hundred dollars worth of
real and personal property, for keeping the roads of any town-
ship in said county in good and proper. repair for such year.
2. Before any such contract shall be binding, it shall be the
duty of the commissioner of roads in such township to sub-
mit the same to the township board for its ratification or re-
jection. If the board disapprove thereof it shall be set aside;
but the same may be altered or modified, with the consent of
the parties thereto, until ratified by said township board, and
thereupon it shall have the force and effect of a legal obliga.
tion; and suits may be instituted in any of the courts of the
county upon said bonds or against said supervisors, township
boards or contractors to compel compliance with said obliga-
‘tion.
3. All roads in any township of said county not contracted
for under this act shall be worked and kept in repair as now
provided for by law under acts of eighteen hundred and sixty-
nine and eighteen hundred and seventy, and eighteen hundred
and seventy-one and eighteen hundred and seventy-two, in re-
lation to roads.
