AN ACT to amend and reenact § 15-900 of the Code of 1950, re-
lating to municipal planning and planning commissions.

Be it enacted by the General Assembly of Virginia:
1. That § 15-900 of the Code of 1950 be amended and re-
enacted as follows:
§ 15-900. Grant of power to municipality—A municipali
ty may make, adopt, amend, extend, add to or carry out a muni.
cipal plan as provided in this article. A council of a municipali.
tv is hereby empowered to create by ordinance a planning com.
mission with the powers and duties herein set forth. The plan-
ning commission of a city shall be designated the city planning
commission; of a town, the town planning commission. Any
planning commission heretofore created by charter or ordinance
may be deemed a planning commission under this article. In
leu of appointing a planning commission for a town as provided
in this section, the council of such town may if it so desires re-
quest the board of supervisors of the county in which the town
is located to instruct the county planning commission to serve
also as the planning commission for such town, and if the board
of supervisors is agreeable to such request it may so enstruct its
county planning commission; in which case the county planning
commission shall also serve as the planning commission of such
town. In the performance of its duties as the planning commis-
sion of such town it shall be governed by the provisions of this
article.
