CHAPTER 305
AN ACT to authorize the Director of Conservation and Develop-
ment, with the approval of the Governor, to convey to the
United States certain lands or interests therein, within or
appurtenant to Fairy Stone State Park. rH 490)

Be it enacted by the General Assembly of Virginia:
1. § 1. The Director of Conservation and Development, with
the approval of the Governor, is hereby authorized to give,
grant, convey and transfer to the United States of America, all
and any right, title, or interest which the Department of Conser-
vation and Development, or the State of Virginia, has in or to such
land or lands as lie within or are appurtenant to, Fairy Stone
State Park, for the purpose of temporary, periodic, or permanent
flooding in connection with the construction and operation by the
United States of the Philpott Dam and Reservoir; provided,
however, that should the United States and the Virginia Depart-
ment of Conservation and Development determine that the con-
veyance of a lesser interest would satisfy the requirements of
the United States, the Director of Conservation and Develop-
ment, with the approval of the Governor, may convey such lesser
interest to the United States of America under such terms and
conditions and for such consideration as may be lawful, reason-
able and proper.
§ 2. Any deed or deeds, or conveyance or conveyances,
made to the United States in pursuance of these sections shall
be executed in the name of the Commonwealth and the Depart-
ment of Conservation and Development, and shall be signed by
the Director of Conservation and Development and the Gover-
nor and shall be attested by the Secretary of the Commonwealth
and sealed with the great seal of the Commonwealth, and no
i9ther warrant or authority shall be required for the registra-
‘ion of any such instrument.
