CHAPTER 21
AN ACT to amend the Code of 1950 by adding a section num-
bered 15-94.1 relating to the residences of county officers
in towns which become cities.

Be it enacted by the General Assembly of Virginia:
1. That the Code of 1950 be amended by adding a section num-
bered 15-94.1, as follows:
§ 15-94.1. Any county officer or county trial justice of
the county who resides in the town, and has an established home
therein, which town has undergone transition to a city of the
second class since such officers’ election or appointment, shall
not vacate his office by reason of his residence in such city, but
shall continue to hold such office so long as he shall be suc-
cessively elected or appointed to the office held by him at the
time of such transition. In any case where any such transition
shall have taken place prior to the effective date of this Act
any such office shall be, and it hereby is, declared not to have
been vacated. Any such officer shall for such purposes be deemed
to be a resident of the Magisterial District wherein the town, be-
fore its transition to a city of the second class, was. This sec-
tion shall not be applicable to cities of the first class.
2. An emergency exists and this act is in force from its
passage.
