CHAPTER 196
AN ACT to allow the town of Wytheville to use, for certain public
purposes, a certain lot in such town; and to vest title to
such lot in such town.

_ Whereas, by deed dated February 19, 1866, in considera-
tion for the conveyance to the county of Wythe of certain real
estate by the heirs and devisees of W. H. Spiller, the said county
of Wythe relinquished all of its right, title and interest in and to
the land formerly occupied by the jail and enclosure around
the same extending from the back of the then court house build-
ing to Monroe Street, to be kept and used as open public ground
for the benefit of the public; and,
Whereas, through the years said lot has steadily deterior-
ated as a place for the use, enjoyment and benefit of the public,
and is now used largely as a private parking area by adjacent
garages; and,
Whereas, said lot is not now being used for the purposes
originally intended; and,
Whereas, the town of Wytheville for some time has been
desirous of taking over and improving the said lot for the use
and enjoyment of the public generally but due to certain ques-
tions as to its authority so to do, such improvements have never
been effected ; and,
Whereas, said lot doubtless will continue to deteriorate be-
cause of the lack of supervision and maintenance and it would
be in the public interest for said lot to be taken over, maintained
and improved by the town of Wytheville; now, therefore
Be it enacted by the General Assembly of Virginia:
1. § 1. That there is hereby transferred to and vested in
the town of Wytheville as the proper public agency all right,
title and interest of the public in that certain lot in the town
of Wytheville lying northwest of a line one hundred twenty
feet northwest of and parallel to the northwest line of Main
Street in said town, and bounded on the east by the west line
of Tazewell Street, on the west by the store property of Rolfe M.
Miller and S. K. Kincer, on the north by the south line of
Monroe Street and on the south by the property of Mrs.
Edmonia C. Hatcher.
2. An emergency exists and this act is in force from its
passage.
