Chap. 319.—An ACT to Amend and Re-enact an Act entitled an Act to
Provide for a Re-division of the Oounty of Fairfax into Townships.
Approved March 31, 1878.
1. Be it enacted by the general assembly of Virginia, That
an act entitled an act to provide for a re-division of the county
of Fairfax into townships, in force January sixteenth, eighteen
hundred and naventy-thines, be amended and re-enacted 80 as to
read as follows:
§ 1. That it shall be the duty of the governor of this com-
monwealth, as soon after the passage of this act as may be, to
appoint in the county of Fairfax three discreet men, citizens of
said county, to re-divide said county into three and (in their
discretion) not more than four townships; and he shall inform
said commissioners forthwith of their appointment.
§ 2. The said commissioners shall proceed without delay to
the discharge of the duties imposed upon them by this act,
conforming in all respects in their action to the provisions of
an act approved April second, eighteen hundred and seventy,
entitled an act to provide for dividing the several counties of
this state into townships.
§ 3. It shall be the duty of the county court of said county,
upon the petition of fifty or more of the qualified voters of
said county, to issue an order to the several officers conducting
alections in the said county, at the time and places for holding
the general election on the fourth Thursday in May, eighteen
oundred and seventy-three, to prepare a separate ballot-box for
ach voting precinct, in which shall be deposited the ballots of
the then qualified voters who shall desire to vote upon the pro-
posed change or re-division of said county into townships.
[he said ballots shall be respectively, as follows: For the re-
livision of the county into townships, and against the re-divi-
sion of the county into townships. Each ballot so cast, which
shall have written or printed thereon for the re-division of the
county into townships, shall be taken and counted as a vote for
the re-division of the county into townships, and each ballot
which shall have written or printed thereon against the re-
livision of the county into townships, shall be taken and
counted as a vote against the re-division of the county into
townships.
§ 4. The manner of receiving and canvassing the ballots cast
at such election on the question of the re-division of the said
county into townships, and making returns and abstracts of
the results thereof, shall conform in all respects to the regula.
tions prescribed by the general election law of this state, ex-
cept that the certificates of the judges of the election shall be
as follows: We hereby certify that at the election held at ——
precinct votes were cast for the re-division of the county
into townships, and votes were cast against the re-divi-
sion of the county into townships.

§ 5. If, from such returns and abstracts of votes so cast
upon the question of the re-division-of the said county into
townships, it shall appear that a majority of the votes so cast
are in favor of such re-division, then the said re-division shall
take effect on the first day of July, eighteen hundred and
seventy-four, and the election of township officers for said
townships shall be held on the fourth Thursday in May,
eighteen hundred and seventy.four, in accordance with existing
laws: provided, that at that election there shall be elected in
each township three justices of the peace and three constables,
whose terms shall be one, two and three years respectively.
But if from such returns and abstracts of votes so cast upon
the question of the re-division of said county into townships
it shall appear that a majority of the votes so cast are against
such re-division, then this act shall be void and of no effect.
2. This act shall be in force from its passage.
