Chap. 288.—An ACT Declaring Certain Parts of the Chickahominy River
a Public Highway.
Approved March 29, 1873.
1. Be it enacted by the general assembly, That the Chicka-
hominy river, from the Chesapeake and Ohio railroad crossing,
to the New Kent county line, shall be considered and is hereby
declared to be a public highway, and shall be subject to all the
provisions of law in reference to public roads now im force,
and applicable thereto, except as hereinafter provided.
2. It shall be the duty of the county courts of Hanover and
Heprico counties to appoint, each, a commissioner, who shall
assess the value of the flat lands lying on both sides of said
river, between the points designated in the first section of this
act, and, annually, estimate and assess the benefit which shall
accrue to the flat lands of contiguous landholders, between the
points mentioned in the first section and above, when the lands
above will receive benefit by keeping the river cleared out and
free from obstructions; and the owners of said lands shall,
each year, be assessed pro rata on said estimate, for a sum
sufficient in the aggregate to meet all the expenses necessary
to keep said river, on which their lands lie, cleared out and
free from obstructions; which said sum shall be fixed by the
board’of supervisors of Hanover and Henrico counties, at
their annual December meeting, or as soon as practicable after
receiving the report of said commissioners, and shall be .col-
lected by the said overseers in the same way that the road
taxes are now collected; and the land owners shall have the
privilege of furnishing labor to meet the tax imposed on them,
as is now provided in the case of roads: provided, however,
that the Hanover and Henrico commissioners and supervisors.
shall act separately and independently respecting the assess-
ments for their respective counties.
3. This act shall be in force from its passage.
Ona 289.—An ACT to amend and Re-enact the fifth Section of an Act
entitled an Act to amend the Charter of the Town of Christiansburg,
and Extending the Limits of the same.
Approved March 29, 1873.
1. Be it enacted by the general assembly of Virginia, That
the fifth section of an act entitled an act to amend an act
incorporating the town of Christiansburg, and extending the lim-
its of the same, passed March fourteenth, eighteen hundred
and sixty-one, be amended and re-enacted so as to read as fol-
lows:
§ 5. The council may appoint a treasurer and such other offi-
cers as may .be necessary, and fix their duties and compensa-
tion; and they shall have power to pass all by-laws and ordi-
nances, deemed by them necessary to suppress crimes forbid-
den by the laws of this commonwealth; to prevent. and sup-
press disorderly, riotous and indecent conduct, and all viola-
tions of public morals; to forbid and prevent the vending or
other disposition of liquors and intoxicating drinks on the
Sabbath day, within the limits of said corporation; and to for-
bid and prevent the selling or giving any intoxicating liquors
or wines to any person under twenty-one years of age, without
the consent of his or her parents or guardian; and shall also
have power to enforce all such by-laws and ordinances, and
provide the mode and manner of punishing their infraction and
violation, by fine not exceeding ten dollars, and by imprison-
ment in the county jail of Montgomery county, not exceeding
thirty days for any one offence.
