Chap. 274.—An ACT to Authorize the County Court of Norfolk County
to appoint Commissioners to divide the Roads of the various Townships
in said County into Convenient Road Districts, and to Contract Annu-
ally for keeping in repair the Public Roads in said County.
In force March 29, 1873.
1. Be it enacted by the general assembly, That it shall be the
duty of the county judge of Norfolk county, in the month of Jan-
uary in each year, or as soon thereafter as practicable, to ap-
point three discreet persons in each of the townships of said
county, who, with the road commissioner of the township and
the district road overseer, shall constitute a board, whose duty
it shall be to divide their respective townships into convenient
road districts and sections, and to advertise annually that they
will, on a specified day, receive proposals for keeping the roads
in the several road districts and sections of their respective
townships in repair, in the manner to be specified in their stip-
ulations. Upon receipt of such proposals, they are hereby
authorized to accept the lowest and best bid. The said com-
missioners may thereupon enter into contract with the party
or parties whose proposal may be accepted, to execute the work
according to agreement, requiring proper bond and security
for the performance of the stipulations. But in no contract
for any one year shall any township be bound for more than
the amount of the levy made by the township board of said
township for keeping the roads of said township in good and
proper repair for such year.
2. Before any such contract shall be binding, it shall be the
duty of the commissioners to submit the same to the county
court for its ratification or disapproval. If the court disap-
prove thereof, it shall be set aside, but the same may be al-
tered or modified, with the consent of the parties thereto, until
ratified by said court; and thereupon it shall have the force
and effect of a legal obligation; and suits may be instituted in
said court to enforce the provisions of and compel compliance
with said obligation.
3. The commissioners shall receive for their services under
this act a compensation to be ascertained by the county court
of said county: provided, that no commissioner shall receive an
amount exceeding ten dollars for services rendered in any one
year. The said compensation to be a charge upon and paid
out of the county levy.
4, This act shall be in force from its passage.
