Chap. 78.—An ACT to amend Chapter 432 of the Acts of Assembly of 1936,
approved March 30, 1936, and know as the Uniform Principal and Income
Act, by adding thereto a new section numbered Section 3%, relating to the
payment of income earned upon the assets of an estate during the period of
administration {S 138}

Be it enacted by the General Assembly of Virginia:
1. That chapter four hundred thirty-two of the Acts of As-
sembly of nineteen hundred thirty-six, approved March thirtieth,
nineteen hundred thirty-six, and known as the Uniform Principal
and Income Act, be amended by adding thereto a new § section
numbered three and one-half as follows:
Section 31%. Income from certain residuary estates—disposi-
tion—(a) Where the whole or any part of the residuary estate
of a decedent is devised or bequeathed to or in trust for a tenant or
tenants, all income earned from the date of the death of the
testator through the period of administration by the personal
representative and not payable to others, or otherwise disposed
of by the will, shall not be added to the principal of the residuary
estate but shall be distributed as income to the tenant or tenants
entitled thereto.
(b) The provisions of this section shall not apply to the
estate of any person dying prior to April first, nineteen hundred
forty-eight.
2. An emergency exists and this act is in force from its passage.
