Chap. 502.—An ACT to-amend and reenact Section 1, and to repeal Section 2,
of Chapter 99 of the Acts of Assembly of 1946, "approved March 6, 1946,
authorizing the State Highway Commission to improve certain private roads
and town streets, so as to transfer such powers and authority to the State
Highway Commissioner. {S 216]

Be it enacted by the General Assembly of Virginia:
1, That section one of chapter ninety-nine of the Acts of Assembly
of nineteen hundred forty-six approved March six, nineteen hundred
forty-six be amended and reenacted as follows:
Section 1. The State Highway Commissioner may, in his discretion,
upon the request of the board of supervisors of any county and at the
expense of the owner of the land, improve private roads giving direct
access from the home or other central buildings on the property along
the shortest practical route to the nearest public highway, and upon the
request of the council of any town having a population less than fifteen
hundred inhabitants according to the last preceding United States census,
and at the expense of said town, improve and maintain any streets or
roads therein not in the State highway system. The work, if done by
the Commissioner, shall only be done with the equipment and employees
of the State Highway Commission, The Commissioner shall in no case
undertake any such work until certification is made by the board of
supervisors that the property owner cannot secure the services of a pri-
vate contractor to perform the work nor then until the owner has
deposited with him a certified check in the amount estimated by the
Commissioner as the cost of the work; provided that not more than one
thousand dollars shall be expended on any one such private project in
any one year, and provided further that as to streets and roads in towns
aforesaid, no certification by the board of supervisors or deposit shall
be necessary. No work of ordinary maintenance shall be done on any such
private road under the provisions of this act.
2. Section two of chapter ninety-nine of the Acts of Assembly on
nineteen hundred forty-six, approved March six, nineteen hundred forty-
six, is repealed.
