Chap. 50.—An ACT to repeal 284, as of the Acts of Assembly
of 1930, approved March 24, 1930, and to amend the Code of Virginia by adding
a mew section numbered 3035-c 1 relating to appropriations by counties,
Cities and towns for the relief of injured police officers, firemen, officials and
other employees of such counties, cities and towns. (H 58]

Be it enacted by the General Assembly of Virginia:
1. That chapter two hundred eighty-four of the Acts of As-
sembly of nineteen hundred thirty, approved March twenty-four,
nineteen hundred thirty, and all amendments thereof are repealed.
2. That the Code of Virginia be amended by adding a new
section numbered thirty hundred thirty-five-c one, as follows:
Section 3035-c 1. Allowances to police officers, firemen, officials
and employees of counties, cities and towns injured in performance
of duties ——The board of supervisors of any county and the council
of any city or town are authorized in their discretion to make al-
lowances by appropriation of funds, payable in monthly or semi-
monthly installments, for the relief of any of their police officers,
firemen, officials and other employees who suffer injury as defined
in the Virginia Workmen’s Compensation Act, whether such injury
was suffered before or after the effective date of this section. The
allowance shall not exceed the salary or wage being paid to such
police officer, fireman, official or employee at the time of such
injurv, and the payment of the allowance shall not extend beyond
the period of disability resulting from such injury. In counties,
cities and towns which have established retirement or pension
systems for injured, retired or superannuated officers and employees
and members of police and fire departments, the agencies provided
for the administration of such systems shall determine the existence
of such injury before any appropriation to pay such allowance is
made and shall determine the extent of and period of disability
resulting from such injury. All sums paid to any such police officer,
fireman, official or employee as compensation under the Virginia
Workmen’s Compensation Act and all sums paid to him or her
under such retirement or pension system shall be deducted from
the allowance made under this section in such installments as such
agency shall determine. Should such agency determine that any
such police officer, fireman, official or employee is engaged or is
able to engage in a gainful occupation, then such allowance shall
be reduced by such agency to an amount which, together with
the amount earnable by him or her, shall equal such allowance.
Should the earning capacity of such police officer, fireman, official
or employee be later changed, such allowance may be further modi-
fied, provided the new allowance shall not exceed the amount of
the allowance originally made nor an amount which, when added
to the amount earnable by him or her, equals such allowance.
