Chap. 274.—-An ACT to amend Chapter 342 of the Acts of Assembly of 1932,
approved March 26, 1932, as amended, such chapter being known and designated
as “The Motor Vehicle Code of Virginia”, by adding thereto a new section
designated Section 24, relating to the service of process on non-residents and
residents who depart from this State. (H 154]

Be it enacted by the General Assembly of Virginia:
1. That chapter three hundred forty-two of the Acts of
Assembly of nineteen hundred thirty-two, approved March twenty-
six, nineteen hundred thirty-two, as amended, such chapter being
known and designated as “The Motor Vehicle Code of Virginia”,
be amended by adding thereto a new section designated section
twenty-four as follows:
Section 24. Further provisions as to notice to non-residents
and residents who have left the State—Subsection (i) of section
twenty-three of this act is subject to the following provisions:
(1) The term “non-resident” includes any person who though
resident when the motor vehicle accident or collision occurred, has
been continuously outside the State for at least sixty days next
preceding the day on which notice or process is left with the
Commissioner. '
(2) The mailing required by subsection (i) of section twenty-
three shall be to the last known postoffice address of the defendant
or defendants but if there is left with the Commissioner, along
with the notice of process an affidavit of the plaintiff that he does
not know and is unable to ascertain any postoffice address of the
defendant or defendants, service of the notice or process shall be
valid without the mailing otherwise required by subsection (i).
