Chap. 193.—An ACT to amend and reenact Section 3, as amended, of Chapter
144 of the Acts of Assembly of 1934, approved March 22, 1934, relating to
drunk driving. [H 328]

Be it enacted by the General Assembly of Virginia:
1. That section three, as amended, of chapter one hundred
forty-four of the Acts of Assembly of nineteen hundred thirty-four,
approved March twenty-two, nineteen hundred thirty-four, be
amended and reenacted as follows:
Section 3. The judgment of conviction, if for a first offense
under this act, or for a similar offense under any city or town ordi-
nance, shall of itself operate to deprive the person convicted, of the
right to drive or operate any such vehicle, conveyance, engine or
train in this State for a period of one year from the date of such
judgment, and if for a second or other subsequent offense within
ten years thereof for a period of three years from the date of the
judgment of conviction thereof. If any person has heretofore been
convicted of violating any similar act of this State and thereafter
is convicted of violating the provisions of section one of this act,
such convictién shall for the purpose of this act be a subsequent
offense and shall be punished accordingly; and the court may, in
its discretion, suspend the sentence during the good behavior of
the person convicted. If any person so convicted shall, during the
time for which he is deprived of his right so to do, drive or operate
any such vehicle, conveyance, engine or train in this State, he shall
be guilty of a misdemeanor; but nothing in this act shall be con-
strued as conflicting with or repealing any ordinance or resolution
of any city, town or county, heretofore or hereafter adopted, which
restricts still further the right of such persons to drive or operate
any such vehicle or conveyance.
