Chap. 397.—An ACT to provide for the development, use and maintenance of a
war memorial in the City of Radford, and to that end to authorize and em-
power, the City of Radford and the School Board of such city to contract with
each other and with certain associations in relation to a certain athletic field
as a memorial; to prescribe the rights, powers, duties, and obligations of the
parties to, and under, such contract; to authorize contributions and dona-
tions to be made to, and accepted for, such memorial and to prescribe how
same shall be disposed of; and to authorize the city to provide for the use of
such memorial. [H B 421]

Be it enacted by the General Assembly of Virginia :
1. Section 1. The council of the City of Radford and the school
board of such city, through their authorized agents, are hereby authorized
to enter into a contract with each other and with any association to per-
petuate the memory of war veterans for the development, maintenance
and use of a certain athletic field under the control of such board as a
living memorial to the war veterans of such city. If such contract be so
entered into the parties thereto may provide that the city or such associa-
tion may cause to be erected on such property a stadium and other struc-
tures necessary thereto, out of city funds and out of any other funds
contributed for such purposes.
Section 2. Any such contract may further provide that the city may
provide for the maintenance of structures thereon and the use, subject
to the needs of the school board and schools of such city, at such times,
for such charges and under such conditions as the city may prescribe.
Section 3. The school board shall retain such control of the field
and stadium as it deems desirable and necessary for the uses and needs
of the schools and school board ; subject to such reservations the city shall
be vested with the management and control of any stadium erected on the
property involved in the contract and improvements thereon, subject to
the uses and needs of the schools and school board, and may prescribe
such rates of charge for use thereof or admission thereto and conditions of
use as are deemed proper; funds raised thereby may be devoted to such
purposes as the school board and city agree upon. The contract shall
specifically set forth the rights, duties and obligations of the parties there-
under, and shall further state therein the control which the school board
retains for the the uses and needs of the schools and school board. The
city may contribute such sums to the erection and maintenance of the
stadium as it deems proper and may provide for the administration of the
stadium and the funds derived therefrom or contributed thereto by the
appointment of not more than five trustees to hold office for not more
than two years. The city and school board may appoint an equal num-
ber of trustees and those so appointed shall select a trustee. Any trustee
may be removed by the appointing authority at any time.
Section 4. If the contract be entered into also by any association to
perpetuate the memory of war veterans such association may donate any
funds for a memorial to such veterans in accordance with the terms of the
contract and such sums shall be employed for the purposes for which
donated and the association and its representatives shall have such pow-
ers and rights as may be granted them under such contract.
Section 5. In order to effectuate the purposes of this act and pro-
vide for a memorial to such war veterans the school board and City of
Radford are hereby authorized and empowered to contract in regard to
such other matters and perform such acts as are necessary to accomplish
such purposes.
