Chap. 348.—An ACT to provide for the issuance by the Town of Drakes Branch
of bonds in the aggregate sum of $77,000 for the purpose of providing water
works and a water supply system for the town, the principal and interest of
such bonds to be made payable exclusively from the revenues derived from
such water system; to prescribe the procedure leading up to and in connection
with the issuance of such bonds, including the holding of an election on the
question, and to provide how such bonds shall be issued. (H B 422

Be it enacted by the General Assembly of Virginia:
1. Section 1. Upon the adoption by the council of the Town of
Drakes Branch, by the recorded affirmative vote of a majority of all the
members elected to the council, of an ordinance reciting the expediency of
borrowing seventy-seven thousand dollars and issuing bonds therefor,
for the purpose of providing water works and a water supply system for
the town, the length of time for which they are to run, the interest to be
paid thereon, and that the principal and interest of such bonds are to be
made payable exclusively from the revenue derived from such water
system, a certified copy of the ordinance shall be forthwith presented to
the circuit court of Charlotte county, or to the judge thereof in vacation.
Section 2. Said court or judge, on the receipt of the said certified
copy of such ordinance, shall, by an order entered in term or vacation,
direct the proper election officers of said town to take such steps and
prepare such means as may be necessary to submit to the qualified voters
of the town, either at the next succeeding general election, or at a special
election, for determining the question of whether such bonds shall be
issued, and the court or judge shall make such order as may be proper
to give due publicity to such election.
Section 3. The ballots to be voted at such election shall be pre-
pared, printed, delivered and voted, and the election shall be held and
conducted, the returns thereof made and canvassed, and the result there-
of certified to the judge of the court ordering the election, in accord-
ance with the provisions of sections thirty hundred eighty-five, thirty
hundred eighty-six and thirty hundred eighty-seven of the Code of Vir-
ginia.
Section 4. Ifa majority of the qualified voters at such election shall
be in favor of such bond issue, the court or the judge thereof shall enter
an order accordingly, a copy of which shall be forthwith certified by the
clerk of the court to the town council, and the council shall be thereupon
fully authorized and empowered to prepare and issue, and to sell or to
negotiate the bonds of the town in the aggregate sum of seventy-seven
thousand dollars, in such denominations as the council deems proper,
and in accordance with the recitals contained in the ordinance provided
for in section one hereof, as to the length of time for which the bonds
are to run, the interest to be paid thereon, and the revenue from which
both the principal and interest of the bonds shall be made payable.
