Chap. 291.—An ACT to amend and re-enact Section 1080-a of the Code of Vir-
ginia, as amended, relating to the appointment of guardians or committees for
persons incapable of taking care of their person or property. {H B 154]

Be at enacted by the General Assembly of Virginia:
1. That section ten hundred eighty-a of the Code of Virginia, as
amended, be amended and re-enacted, as follows:
Section 1080-a. Appointment of guardian or committee for person
incapable of taking care of person or property.—On petition of any per-
son in interest to the circuit court of the county, or to any court having
jurisdiction for the appointment of guardians or committees of infants
or insane persons of the city, in which any person who by reason of ad-
vanced age or impaired health, or physical disability, has become mentally
or physically incapable of taking proper care of his person or properly
handling and managing his estate, resides, the court or the judge in va-
cation, after reasonable notice to such person and after hearing on the
petition if convinced that he is incapacitated to the extent above men-
tioned, may appoint some suitable person to be the guardian or commit-
tee of his person or property, and the guardian or committee shall have
the same rights and duties which pertain to committees and trustees ap-
pointed under sections ten hundred fifty, ten hundred fifty-a or ten hun-
dred fifty-one of the Code, as from time to time amended, and shall give
such bond as is required by the court or judge. On the hearing of every
such petition a guardian ad litem shall be appointed to represent the in-
terest of the person for whom a committee or guardian is requested
and he shall be paid such fee as is fixed by the court or judge to be taxed
as part of the costs of the proceeding.
The Chancery Court of the City of Richmond or the judge thereof in
vacation shall have exclusive jurisdiction to appoint a guardian or com-
mittee under this section for any person who resides jn any part of the
territory of the City of Richmond which les on the north side of the
James River.
