Chap. 272.-An ACT to authorize the State Hospital Board to sell and convey
certain lands, of the Western State Hospital in or near Staunton, Virginia.

Be it enacted by the General Assembly of Virginia:
1. Section 1. The State Hospital Board is authorized and em-
powered, with the written approval of the Governor, to sell for such con-
sideration and on such terms as it shall deem best, and to convey by
proper deed or deeds executed by its chairman and under its seal, all
right, title and interest of the Western State Hospital and of the Com-
monwealth of Virginia in and to the following lots or parcels of land in or
near the City of Staunton, Virginia:
Tracts Numbered 1-A, 1-B, and 1-C.
Three certain tracts of land in Augusta County, Virginia, east of
the City of Staunton, containing together one hundred one and sixty-nine
one-hundredths acres, more or less, being the eastern portion of the main
hospital property known as Hospital Tract Number One of the lands of
the Western State Hospital and consisting of three parcels of land desig-
nated as Parcel One-A, Parcel One-B, and Parcel One-C on a plat made
by John S. Hale, consulting engineer, dated January twenty-three, nine-
teen hundred forty-six, entitled ‘Map of a Portion of the Hospital Tract”,
Western State Hospital, Staunton, Virginia, which plat is duly recorded
in the clerk’s office of the Circuit Court of Augusta County, Virginia, as
Document Number twelve thousand two hundred sixty in Deed Book
Number three hundred thirty-six, to which plat special reference is here
made for a more particular description of the land.
Tract No. 2.
A tract of land containing one and seventeen one-hundredths acres,
more or less, situated in the County of Augusta, Virginia, just east of the
City of Staunton, across United States Route two hundred fifty from the
main hospital tract, and bounded on the north by the right of way of the
Chesapeake and Ohio Railway Company, on the east by Lot One of the
F. M. Parker Subdivision, on the south by United States Route two hun-
dred fifty, and on the west by lands of The Erskine Company, Incor-
porated, and known as Tract Number Two of the lands of the Western
State Hospital.
Tract No. 4.
A small triangular lot of land containing forty-five one-hundredths
(0.45) acres, more or less, situated in the City of Staunton, Virginia,
across United States Route eleven (New Greenville Avenue) from the
main hospital tract, between United States Route Eleven and the old
Greenville Road, and known as Tract Number Four of the lands of the
Western State Hospital.
Tract No. 6.
A lot of land containing approximately two acres, situated in the
County of Augusta about one mile east of the City of Staunton, across
United States Route two hundred fifty from other lands of the Western
State Hospital, bounded on the north by the old road to Waynesboro,
on the east by a fifteen foot strip reserved along the west line of the right
of way of the Chesapeake and Ohio Railway Company, on the south by
United States Route two hundred fifty leading to Waynesboro, and on
the west by county road number six hundred forty-four, and being a por-
tion of the Harnsberger Tract of the lands of the Western State Hospital.
Trace No. 7.
A tract of land containing two hundred seven acres, more or less,
situated in the County of Augusta, Virginia, about two and one-half
miles south of the City of Staunton on the old Greenville Road, consisting
of two separate tracts, one known as Keyser Tract Number Two of the
lands of the Western State Hospital, lying north of the old Greenville
Road and containing one hundred six acres, more or less, and being a
portion of the land which was conveyed to the Western State Hospital
by W. H. Landes, Special Commissioner of the Circuit Court of Augusta
County in the Chancery Cause of “Melville K. Shirkey and others versus
Joseph C. Shirkey and others’, by deed dated October six, nineteen
hundred twenty-five, and recorded in the clerk’s office of the Circuit
Court of Augusta County, Virginia, in Deed Book Number two hundred
twenty-three, page one hundred twenty, and the other known as the
Jones Tract of the lands of the Western State Hospital, lying north of
the old Greenville Road and adjoining Keyser Tract Number Two on the
east, containing one hundred one acres, more or less, and being the same
land which was conveyed to the Western State Hospital by A. H. Jones
and wife, by deed dated April nine, nineteen hundred fourteen, and re-
corded in said clerk’s office in Deed Book number one hundred seventy-
six, page three hundred twelve, to which deed reference is here made for
a more particular description of such land.
Tract No. 8.
A certain right of way twelve feet in width lying along the southern
line of the right of way of the Chesapeake and Ohio Railway Company
and extending over and across the northern portion of a lot of land in the
City of Staunton, Virginia, owned by the Erskine Company, Incorpora-
ted, and known as Number Four hundred thirty-eight Waynesboro Road,
and being the same right of way that was conveyed to the Western State
Hospital by W. A. Payne and wife and McChesney Goodall and wife, by
deed dated February three, nineteen hundred twenty-seven, and recorded
in the clerk’s office of the Corporation Court of the City of Staunton, Vir-
ginia, in Deed Book Number thirty-five, page two hundred fifty.
Tract No. 9.
A lot of land containing approximately three-tenths of an acre, with
the two frame residences thereon known as Numbers Four Hundred and
Four Hundred Two Waynesboro Road, lying within the City of Staun-
ton, Virginia, across United State Route two hundred fifty from the main
hospital property, bounded on the north by the right of way of the
Chesapeake and Ohio Railway Company, on the east by lands of the
Blue Ridge Storage Company, Incorporated, on the south by United
States Route two hundred fifty leading to Waynesboro, and on the west
by a road leading from United States Route two hundred fifty northward-
ly across the tracks of the Chesapeake and Ohio Railway Company, and
being the eastern portion of Tract Number Three of the lands of the
Western State Hospital.
Section 2. The lots or parcels of land herein authorized to be sold
and conveyed may be conveyed subject to any and all easements or rights
of way affecting such lands, and in making such sale and conveyance the
State Hospital Board may reserve such easements and other rights 1n the
lands conveyed as may be necessary for the protection of the remaining
property of the Western State Hospital.
Section 3. Before making sale of Tract Number Six described
herein the State Hospital Board may convey to the State Highway De-
partment or to the State of Virginia for the widening of United States
Route two hundred fifty a strip of land approximately six feet in width
lying along the southern boundary of said Tract Number Six, together
with all cut and fill easements necessary for the widening and grading of
such highway, in exchange for a strip of land approximately fifteen feet
in width laying along the northern boundary of Tract Number Six,
formerly a part of the right of way of the old road leading to Waynesboro,
and may sell and convey, along with Tract Number Six, any such addi-
tional land so acquired. The Board shall also convey to the State High-
way Department, prior to such sale, a thirty foot right of way across
Tract Number Six for a road leading from United States Route two
hundred fifty to the old road to Waynesboro, the exact location of such
right of way to be so designated by the State Highway Department as to
provide an adequate and convenient connection between the two roads.
Section 4. Any tract or parcel of land herein authorized to be sold
may be sold as a single tract, or in such lots or parcels as the State
Hospital Board may deem best. The Board may, in its discretion, grant
and convey to the Erskine Company, Incorporated, without any consid-
eration except the payment of all legal and other charges in connection
with such conveyance, the right of way described herein as Tract Num-
ber Eight.
