Chap. 257.—-An ACT to authorize the governing bodies of certain counties to
improve certain private roads upon certain terms and under certain circum-
stances. [H B 245]
Approved March 25, 1946
Be it enacted by the General Assembly of Virginia:
1. Section 1. The governing body of any county which has
chosen, or hereafter chooses, not to be included in the provisions of chap-
ter four hundred fifteen of the Acts of Assembly of nineteen hundred
thirty-two, as amended, may, upon the request and at the expense of the
owner of the land, improve private roads giving direct access from the
home or other central buildings on the property along the shortest prac-
tical route to the nearest public highway. The work, if done by such
governing body shall only be done with its own equipment and employees.
No such governing body shall in any case undertake any such work until
certification is made to it by the property owner that he cannot secure
the services of a private contractor to perform the work nor then until
the owner has deposited with such governing body a certified check in
the amount estimated by it as the cost of the work. No work of ordinary
maintenance shall be done on any such private road under the pro-
visions of this act.
Section 2. No road shall be improved under the provisions of
this act unless it does not interfere or conflict with the needs of other
roads in any such county and not more than five hundred dollars shall
be expended on any one such private project in any one year.
