Chap. 5.—An ACT to amend Chapter 94 of the Acts of 1934, known as ‘The Al-
coholic Beverage Control Act’, by adding thereto a new section, to be desig-
nated and numbered section 4-a, so as to restrict the exercise of certain powers
of the Alcoholic Beverage Control Board and require the approval of the Gov-
ernor to the exercise of said restricted powers. {[S 9]

Be it enacted by the General Assembly of Virginia:
1. That chapter ninety-four of the Acts of the General Assembly of
nineteen hundred and thirty-four, approved March seventh, nineteen
hundred and thirty-four, known, designated and cited as The Alcoholic
Beverage Control Act, be amended by adding thereto a new section,
numbered section four-a, which new section shall read as follows:
Section 4-a. In exercising the broad general powers conferred on
the board by sub-sections (a) and (m) of section four of this act, the
board shall not purchase any shares of companies manufacturing alco-
holic beverages except in cases where the ownership of said shares will
confer on the board the privilege of purchasing, or receiving as dividends,
a per share allotted quantity of such beverages. Any such shares so pur-
chased shall not be held as an investment, but, after the exercise of the
purchasing privilege incident thereto, or the receipt of such dividends in
merchandise form as the said shares may entitle the owner thereof to re-
ceive, said shares shall be sold by the board as soon as same can be sold
without undue sacrifice in price.
It is expressly provided, further, that the board may purchase or sell
any such shares only in cases where the purchase or sale of the specific
shares proposed to be purchased or sold has been approved in writing by
the Governor.
