CHAP. 45.—An ACT to amend and re-enact Section 2096 of the Code of Virginia,
relating to the use of certain misdemeanants on the State convict road force, so
as to provide for a per diem allowance to such misdemeanants. [S 92}

Be it enacted by the General Assembly of Virginia:
1. That section twenty hundred ninety-six of the Code of Virginia
ye amended and re-enacted, as follows:
Section 2096. A person convicted of misdemeanor may be sentenced
o the State convict road force —Whenever a male person over eighteen
rears of age is convicted of any misdemeanor for which a jail sentence
night be imposed, either for a fixed period of time, or a sentence to serve
n default of payment of fine or in default of surety, the judge or justice
rying the case may, in his discretion, in lieu of committing him to jail,
sentence him to a like period on the public roads, and cause him to be
delivered into the custody of the superintendent of the penitentiary, to
be kept by him as a member of the State convict road force, in accordance
with law, and subject to work on the public roads.
Each such person shall be allowed ten cents a day for each day he
works, to be paid out of funds appropriated for the work of the State
Convict Road Force. This allowance shall be in addition to other credits
and allowances provided by law, and one-half of the amount thereof may
be drawn upon by the prisoner at such time or times as determined by
the Commissioner of Corrections, and the remaining one-half shall ac-
cumulate and be paid to the prisoner at the time of his discharge.
