Chap. 366.—An ACT to amend and re-enact Sections 3775-a, 3775-b, 3775-g, and
3775-h of the Code of Virginia, and to repeal Sections 3775-c, 3775-d, and
3775-£ relating to the regulation of airports and aircraft and the Federal licens-
ing of aircraft and airmen and operation of nonresidents of aircraft for hire,
and to add new sections 3775-w, 3775-x, and 3775-y to provide for license for
airports and fee; for the regulation of rates, fees and charges for use of airports,
and the disposition of fees under this act. [S 187]

Be it enacted by the General Assembly of Virginia:
1. That section thirty-seven hundred and seventy-five-a, section
thirty-seven hundred and seventy-five-b, section thirty-seven hundred
and seventy-five-g, and section thirty-seven hundred and seventy-five-h
of the Code of Virginia, as heretofore amended, be amended and re-
enacted; that section thirty-seven hundred and seventy-five-c, section
thirty-seven hundred and seventy-five-d and section thirty-seven hundred
and seventy-five-f be repealed ; and that section thirty-seven hundred and
seventy-five-w, section thirty-seven hundred and seventy-five-x and sec-
tion thirty-seven hundred and seventy-five-y be added to the Code of
Virginia to read as follows:
Section 3775-a. Definition of terms.—Whenever used in this chap-
ter, unless expressly stated otherwise:
(a) The term “Commission” means the State Corporation Com-
mission of the Commonwealth of Virginia.
(b) The term “person” means any individual, firm, co-partner-
ship, corporation, company, association, or joint stock association, and
includes any trustee, recciver, assignee, or personal representative
thereof.
(c) The term “aircraft”? means any contrivance now known, or
hereafter invented, used, or designed for navigation of, or flight in
the air, except a parachute or other contrivance designed for such
navigation used primarily as safety equipment.
(d) The term “public aircraft’? means an aircraft used exclu-
sively in the service of any state or the Federal government.
(e) The term “civil aircraft” means any aircraft other than a
public aircraft.
(f) The term “airman” means any individual, including the per-
son in command, and any pilot, mechanic, or member of the crew.

individual who is directly in charge of the inspection, maintenance,
overhauling, or repair of aircraft, aircraft engines, propellers, or ap-
pliances ; and any individual who serves in the capacity of aircraft dis-
patcher.
(g) The term “airport”? means a landing area used regularly by
aircraft for receiving or discharging passengers or cargo, and open to
the public for such use.
(h) The term “landing area” means any locality, whether over
land or water, including airports and intermediate landing frtelds.

(1) The term “air space” means all that space above the land
and waters within the boundary of this State.
Section 3775-b. Power to Regulate-—The Commission shall admin-

Section 3775-w. Every person, city, county, or department of gov-
ment before operating an airport and/or landing area shall first secure

Section 3775-y. All fees or sums collected by the Commission under
