Be it enacted by the General Assembly of Virginia:
1. That section fifty-three hundred sixteen of the Code of Virginia
as ainended, be amended and re-enacted as follows:
Section 5316. Appointments of Guardians of Minors.—The circutt
court of any county or the circuit or corporation court of any city, except
the city of Richmond, or the judge in vacation, or the clerk at any time,
in which any minor resides, or, if he be a resident out of the State, in which
he has any estate, may appoint a guardian for him, unless he have a
guardian appointed as aforesaid by his father or mother. The chancery
court and hustings court, part two, of the city of Richmond within their
respective territorial jurisdictions as defined by law and judges in vaca-
tion, and the clerks and their duly qualified deputies at any time, shall
have this power.
All appointments of guardians heretofore made by clerks of the courts
hereinabove mentioned, whether in term time or vacation, are declared
to be as valid and binding and of the same force and effect as if such ap-
pointments had been specifically authorized by law at the time they were
made.
