Chap. 257.—An ACT to amend and re-enact Section 8 of Chapter 382 of the Acts
of Assembly of £934, approved March 29, 1934, providing a new charter for
the City of Hopewell, Section 8 relating to composition of the council. [S 230]

Be it enacted by the General Assembly of Virginia:
1. That section eight of chapter three hundred eighty-two of the
Acts of the General Assembly of nineteen hundred thirty-four, approved
March twenty-nine, nineteen hundred thirty-four, be amended and re-
enacted, as follows:
Section 8. Composition of Council; vacancies—The Council shall
consist of five members, who shall be elected at large and shall serve for a
term of four (4) years from the first day of September next following
the date of their election and until their successors are elected and quali-
fied; provided that at the first election hereunder, two councilmen shall
be elected to succeed those whose terms expire August thirty-one, nineteen
hundred thirty-four, and at the next following election three councilmen
shall be elected to succeed those whose terms expire August thirty-one,
nineteen hundred thirty-six. The Council shall be a continuing body, and
no measure pending before it shall abate or be discontinued by reason of
the expiration of the term of office or removal of the members or any of
them. Vacancies in the council shall be filled within thirty days by a
majority vote of the remaining members provided in case of a tie vote
of the remaining members, the judge of the Circuit Court of the City
of Hopewell shall by his vote break the tie, and the member thus elected
shall serve for the unexpired term created by the vacancy.
