Chap. 256.—aAn ACT to provide for the appointment of special policemen in cer-
tain towns, and to prescribe the conditions upon which such appointments are to
be made, and the powers, duties and compensation of such policemen when so
appointed. [S 229]

Be it enacted by the General Assembly of Virginia:
]. Notwithstanding any other provision of law to the contrary, when
any incorporated town having a population of more than four hundred
and not more than one thousand, as shown by the last preceding United
States census, is located partly in two or more adjoining counties, both
or all of which are in the same judicial circuit, the circuit court thereof
or the judge in vacation may, upon being presented with a certified copy
of a resolution of the governing body of the town requesting that it be
done, appoint a bona fide resident and qualified voter of the town to serve
as a special policeman for the town and the counties, at the pleasure of the
governing body of the town, and a copy of the order making the appoint-
ment shall be entered of record in the common law order book of the
counties and the minute book of the governing body of the town.
Any policeman so appointed shall be a conservator of the peace, and
shall have authority to execute criminal processes within the town and
those parts of the counties that lie without the corporate limits thereof,
and shall receive such compensation as is mutually agreed upon and fixed
by the governing bodies of the town and counties, to be paid by the town
and counties in such proportions as the governing bodies agree upon.
Fees for services rendered by any such policeman shall be the same
as provided by law for sheriffs in similar cases, and shall, when collected,
be disposed of as provided by law for the disposition of other similar
fees. Before any such policeman enters upon his duties, he shall execute
before the clerk of the governing body of the town, bond with approved
security in such penalty as may be prescribed in the order of his appoint-
ment, and conditioned for the faithful performance of his duties.
