Chap. 4.—An ACT to amend and re-enact Section 290 of the Code of Virginia,
relating to the disability of persons holding office under the United States so as
to provide that the provisions of this section and of any other statute having
the effect of prohibiting a State, county or municipal officer or employee from
accepting or holding an office, post, trust or emolument under the government
of the United States shall not be effective during such period as a state of war
exists between the United States and any foreign power. fH B 4]

1. Be it enacted by the General Assembly of Virginia, That section
two hundred and ninety of the Code of Virginia, be amended and re-
enacted, so as to read as follows:
Section 290. Disability of person holding office under United
States.—No person shall be capable of holding any office or post men-
tioned in the preceding section who holds any office or post of profit,
trust, or emolument, civil or military, legislative, executive, or judicial,
under the government of the United States, or who is in the employment
of such government, or who receives from it in any way any emolument
whatever ; and the acceptance of any such office, post, trust, or emolu-
ment, or the acceptance of any emolument whatever under such govern-
ment, shall, ipso facto, vacate any office, or post of profit, trust or
emolument under the government of this Commonwealth or under any
county, city, or town thereof. The provisions of this section and of any
other statute having the effect of prohibiting a State, county or municipal
officer or employee from accepting or holding an office, post, trust or
emolument under the government of the United States shall not be
effective, as to such persons in the armed forces of the United States,
or as to any State, county or municipal officer or employee accepting or
holding an office, post, trust or emolument under the government of the
United States when the compensation attached to such post, office, trust
or emolument does not exceed the sum of twelve hundred dollars a year,
or to any such officer or employee who receives twelve hundred dollars
or less a year from the State, county or municipality, during such period
as the present state of war exists between the United States and any
foreign power.
2. Anemergency existing, this act shall be in force from its passage.
