Chap. 13.—An ACT to amend the Code of Virginia by adding a new section, num-
bered 5333-bl, to provide for jurisdiction of cases pending on the effective date
of Chapter 205, Acts of 1942, which added Sections 5333-a to 5333-1 to the
Code of Virginia: to provide for the further procedure in such cases; to validate
certain orders and actions in cases so pending ; and to declare the existence of
an emergency. [H B 17]

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding a new section, numbered fifty-
three hundred and thirty-three-bl, as follows:
Section 5333-b1. Jurisdiction and procedure, and validation of cer-
tain orders and actions, in pending cases.—Notwithstanding the pro-
visions of section fifty-three hundred and thirty-three-b of the Code,
the court, in any case validly pending before it on the day on which that
section became effective, may retain and continue to exercise jurisdiction
until the conclusion of the case, or may transfer same to any court which
has jurisdiction under that section, and in either case the further pro-
cedure may be either by the court directing a probation officer or other
officer of the court, or an agent of the State or county or city board of
public welfare, or some other discreet and competent person, to make
a careful and thorough investigation of the matter and report his findings
in writing to the court, or may act upon any such report which had been,
or is subsequently, made, in accordance with the practice and procedure
which obtained on the effective date of chapter two hundred and five,
Acts of nineteen hundred and forty-two, or the further procedure may
be according to the provisions of sections fifty-three hundred and thirty-
three-a to fifty-three hundred and thirty-three-] of the Code of Virginia,
as same may be from time to time amended. Every order entered and
every action taken heretofore, whether exercising further jurisdiction or
transferring any case to a court having jurisdiction under the preceding
section, by any court, or by the judge in vacation, in any proceeding for
adoption and change of name of a minor, pending on the day on which the
preceding section became effective, is validated if, and insofar as, other-
wise according to law, whether the court in which, or by whose judge in
vacation, the order was entered, or action taken, did, or did not, have
jurisdiction under the preceding section at the time of the entry of the
order or taking of the action; and the rights of all parties and of all
persons arising under or affected by the proceedings, in any case so pend-
ing, as validated or authorized hereby, shall be the same mutatis mutandis
as if the entire proceeding had been under and in accordance with the
provisions of sections fifty-three hundred and thirty-three-a to fifty-
three hundred and thirty-three-l of the Code if, and insofar as, the
actual proceedings were otherwise according to law.
2. Anemergency exists and this act is in force from its passage.
