1. Be it enacted by the General Assembly of Virginia, That the
‘ublic taxes and arrears of taxes, due prior to the first day of July in the
‘ear nineteen hundred and forty-two, nineteen hundred and forty-three,
nd nineteen hundred and forty-four, respectively, as well as the revenue
nd money derived from all other sources, not segregated by law to
special funds, which shall come into the State treasury prior to the first
lay of July, nineteen hundred and forty-two, nineteen hundred and

Out of this appropriation shall be paid to each
pensioner in the several classes now on the pension
roster, or hereafter placed on the pension roster,
who is entitled, under the act to appropriate public
revenue approved March 9, 1928 (Acts of General
Assembly, 1928, chapter 110), to $320 a year, for
total blindness, $840 a year; to $200 a year for
total disability, $840 a year; and to each widow of
a soldier, sailor or marine, who was married prior
to October 1, 1880, and who has not remarried,
and who is otherwise entitled under this act to a
pension, $180 a year, and to such widow who 1s
blind, $240 a year and to each widow of a Confed-
erate soldier married on or after October 1, 1880,
and prior to January 1, 1921, and who has not re-
married, $144 a year, and to each widow of a Con-
federate soldier who married on or after Janu-
ary 1, 1921, who is over 75 years of age, and
who has not remarried, $144 a year; and to
soldiers proven to be totally deaf by certifi-
cate of a reputable practicing physician and
affidavits by two reputable unrelated disinter-
ested citizens, who are fully acquainted with the
applicant, $840 a year; and to the personal repre-
sentative of each deceased pensioner $45 for the fu-
neral expenses of such deceased pensioner ; provided,
however, that the said sum of $45 may be paid
without the qualification of a personal representa-
tive to the undertaker, when such undertaker shall
file his bill, verified by proper affidavit with the
Comptroller, together with copy of death certificate
of such pensioner, and the allowances as authorized
by act aforesaid; provided, further, that under
the provisions of this act any person who actually
accompanied a soldier in the service and remained
faithful and loyal as the body servant of such sol-
dier, or who served as cook, hostler or teamster, or
who worked on breastworks under any command of

the army and thereby rendered service to the Con-
federacy, shall be entitled to receive an annual pen-
sion of. $84, proof of service to be prescribed by
the Comptroller.
Any unexpended portion of this appropriation
shall revert to the general fund of the State treas-
ury, and no part thereof shall be prorated among
pensioners.
It is further provided that out of the appropria-
tions for public printing, the Director of the Divi-
sion of Purchase and Printing shall supply all forms
and have done and pay for all printing, binding,
ruling, etc., required by the Comptroller in pension
matters and in connection with the payment of pen-
sions. The Comptroller shall pay monthly at such
dates as he may prescribe the pensions authorized
by this act.
It is further provided that out of this appropria-
tion of $376,990 for the first year, and $350,335
the second year, there shall be expended for relief
of needy Confederate women of Virginia, includ-
ing daughters of Confederate soldiers who are now
widows, born not later than December 31, 1875, who
are not upon the State pension roster, and who are
not inmates of any Confederate independent or
church home or charitable institution, in accordance
with the provisions of the act approved March 10,

for the second year, there shall be expended for care
of needy Confederate women who are inmates of
the Home for Needy Confederate Women at Rich-

terest on the public debt funded under the acts
approved February 14, 1882; February 28, 1892;

sinking fund for the redemption of the public debt
prior to January 1, 1934), interest on bonds issued
under an act of the General Assembly of Virginia,
approved April 18, 1927 (Acts of Assembly, 1927,
chapter 93, page 192), interest on refunding bonds
issued under an act approved March 14, 1936, and
interest on money borrowed for the purpose of meet-
ing a casual deficit in State revenue.

There is hereby appropriated to the cities, incor-
porated towns, and counties of the State two-thirds
of the net profits derived under the provisions of
chapter ninety-four of the Acts of nineteen hundred
and thirty-four in excess of two million five hundred
thousand dollars, each city, incorporated town, and
county to receive an amount apportioned on the basis
of their respective populations according to the last
preceding United States census. It is intended that
this item shall provide for the payment to cities, in-
corporated towns, and counties of only so much of the
amounts they would normally receive under the pro-
visions of section sixteen of chapter ninety-four of
the Acts of nineteen hundred and thirty-four as is
embraced in the distribution of two-thirds of the said
net profits in excess of said sum of two million five
hundred thousand dollars, but that, by reason of
other appropriations made out of the general fund of
the treasury for the benefit of said cities, incorporated
towns, and counties, there shall be no distribution of
any of said net profits except two-thirds of so much
of said net profits as are in excess of said sum of two
million five hundred thousand dollars.

incident to the arrest and prosecution of persons
charged with the violation of State laws, including
salaries of attorneys for the Commonwealth, as

where a witness attends in two or more cases on
the same day, only one fee shall be allowed such
witness; where more than two officers participate
in making an arrest, the court may allow fees there-
for to only two such officers; the transportation
costs of the State Board of Public Welfare, as
provided by section 1907 of the Code of Virginia
(1919), and the transportation costs of the Virginia
Manual Labor School for Colored Boys (Acts of
Assembly 1920, chapter 344, pages 515-516), as
provided by the act approved February 5, 1900
(Acts of Assembly, 1899-1900, chapter 273, section
6, page 302), and the transportation cost of the
State prison farm for defective misdemeanants, as
provided by law, cost of maintenance in local jails
of persons charged with violation of State laws,
including food, clothing, medicine, medical atten-
tion, guarding, etc.; provided, however, that all jail
physicians be paid at the rate provided by law, but
not more than five hundred dollars per calendar
year shall be paid the jail physician or physicians
for any city or county, the population of which is
less than 100,000, and not more than one thousand
dollars per calendar year shall be paid the jail phy-
sician or physicians of any city or county, the popu-
lation of which is 100,000 or over, and coroner’s
fees, etc., said compensation for jail physician to

be paid at the end of the calendar year; provided,
however, that in case of death or resignation his
compensation shall be prorated on the basis the
time of service bears to the full calendar year. Pro-
vided, no deduction or cut shall be made in reimburs-
ing any city sergeant or sheriff the actual cost of sup-
plies purchased by him under authority of law, and
provided, further, that no salaries, fees or expenses
shall be paid to any officers out of this appropria-
tion in cases where the Compensation Board 1s
required to fix and ascertain same, or any part
thereof, until after certification by the chairman of
the Compensation Board, to the State Comptroller
of the amounts of the salaries, if any, and expense
allowances of such officers, fixed and ascertained by
said board.
Out of this appropriation shall be paid the sala-
ries and expenses of the parole board and of the
probation and parole officers, according to law.
Out of this appropriation shall be paid the
State’s share of the salaries and expenses of
sheriffs and sergeants and their deputies in ac-
cordance with law. |
It is provided, however, that no part of this ap-
propriation shall be used for the payment of crim-
inal charges incident to prisoners employed on the
State convict road force or at the State industrial
farm for women, or at the State penitentiary farm
and State prison farm for defective misdemeanants,
or the transportation costs of prisoners committed
to the custody of the Virginia Industrial School for

30, 1943 and 1944, shall be applied to a sinking
fund for the redemption of that part of the State

It is provided that $2,080,389 shall be ap-
portioned by the State Board of Education as pre-
scribed by section 135 of the Constitution of Vir-
ginia, on a basis of school population to the pub-
lic free schools of the several counties and cities
of the Commonwealth; provided, further, that the
remainder of this entire appropriation, except as
otherwise provided, shall be apportioned by the
State Board of Education as an equalizing fund
and in such manner that when the total appro-
priation shall have been made it shall have been

distributed on the basis of the average daily at-
tendance of children in school, which principle is
already provided by law; provided, further, how-
ever, that the said State Board of Education shall
not apportion any of the said funds to any county
or city unless said county or city pay out of local
funds at least thirty per cent of the amount ap-
propriated by the State for teachers’ salaries to said
county or city; provided, further, however, that in
exceptional cases the State Board of Education may
except from this requirement a county or city which
is unable to meet the thirty per cent requirement
from local funds, but in no case shall a county or
city be permitted to pay towards the salaries therein,
from local funds less than twenty per cent of the
State appropriation for teachers’ salaries to said
county or city.
It is further provided that if any municipality an-
nexes any portion of any county or counties, the State
Board of Education shall make such equitable adjust-
ment of the funds which would otherwise have gone
to either as is in its opinion justified by the peculiar
condition created by such annexation and order dis-
tribution according to the findings of the State Board
of Education.
It is further provided, however, that where it ap-
pears to the satisfaction of the State Board of Edu-
cation that a county or city, after having provided
a levy or cash appropriation for schools equal to the
average for the counties or cities of the State and
having a ratio of assessed to actual value of property
assessable for school purposes as great as the aver-
age for the State as determined by the State Depart-
ment of Taxation, is unable to pay from local funds
as much as twenty per cent of the State appropria-
tion for teachers’ salaries, then the State Board of
Education may except from the aforesaid reéquire-
ment and permit such county or city to pay from
local funds such per cent, less than twenty per cent,
of the State appropriation for teachers’ salaries as
may be determined by said State Board for any
school year.
It is provided further, that no county or city shall
receive any State funds for schools beyond the con-
stitutional appropriation for any school year if it

shall have reduced its annual expenditures of funds
derived from local taxes for instruction in the public
schools for said year below such expenditures made
for instruction for the preceding school year, pro-
vided, however, in exceptional cases due to a substan-
tial loss in enrollment and average daily attendance
of pupils in a county or city, or in other exceptional
local conditions the State Board of Education may
permit such county or city to reduce such expendi-
tures for instruction as in its opinion is justified by
such exceptional local conditions for any school year.
It is further provided that no funds allocated to any
county or city under this appropriation, or under the
appropriations in items 95 and 96 of this bill, shall
be paid except to reimburse expenses actually in-
curred in the payment of salaries to the teachers in
the public schools of said county or city. Such reim-
bursements shall be paid only after submission of evi-
dence to the satisfaction of the State Board of Edu-
cation that the amount for which reimbursement is
claimed has actually been expended for the payment
of teachers’ salaries, and that the increased funds
made available under this act have been used exclus-
ively to increase the salaries of teachers in the em-
ploy of said city or county.

For aiding the counties and cities in the cost of trans-

It is provided that $500,000 for each year of the
biennium shall be paid by the State Board of Educa-
tion to the counties and cities of the State as an aid

respectively in the proportion that the total number
of school busses operated at public expense in each

such year in the State as a whole.

It is provided that the sum hereby appropriated
shall be expended for the sole purpose of providing
for matriculation fees, board and room rent, books
and supplies, at any educational institution in the
State of Virginia, approved in writing by the Su-
perintendent of Public Instruction, for the use and
benefit of the children not under sixteen and not
over twenty-one years of age of those who were
killed in action or died from other causes in the
‘World War extending from April 6, 1917, to July
2, 1921, while serving in the army, navy or marine
corps of the United States, and of those who were,
or are, or may hereafter become totally and perma-
nently disabled due to service during the said World
War, whether the veteran be now living or dead; pro-
vided, however, that the children of those who did
not enter the service of the United States from the
State of Virginia must have resided in this State
for at least five years prior to the date this act be-
comes effective in order to be entitled to its benefits.
All said children between the ages of sixteen and
twenty-five years who are, or might have been
entitled to aid under the foregoing provision, up-
on recommendation of the State Board of
Education shall be admitted to State institu-
tions of secondary or college grade, free of
tuition. The amounts that may become due to any
such educational or training institution, not in ex-
cess of the amount hereinafter specified, shall be
payable to such institution from the fund hereby
created on vouchers approved by the State Board of
Education. Said board shall determine the eligi-
bility of the children who make application for the
benefits provided for in this act; satisfy itself of
the attendance of such children at such institution,
and of the accuracy of the charge submitted to said
board by the authorities of any such institution on
account of the attendance thereat of any such chil-
dren; provided no member of said board or the
secretary thereof shall receive any compensation for
such services. Not more than $150 shall be ex-
pended for any one child during any one year.

of Public Instruction shall receive an annual salary

amount required to match Federal funds for said
vocational education in trade and industry the fur-
ther sum of $120,000.

ing of said revenues, including any such revenues
brought forward from the year ending June 30,
1942, for the purpose of building and equipping
a dormitory for disturbed patients at the said
DeJarnette State Sanatorium, at a cost of not

penditure for the aforesaid purposes shall be
made out of the general fund of the State treasury.
It is further provided that the superintendent
of the Western. State Hospital may, after setting
aside out of the revenues derived from the opera-
tion, of the DeJarnette State Sanatorium a suf-
ficient amount to pay for maintenance and opera-
tion thereof and the aforesaid interest charges,
and for the construction and equipment of a new
building for disturbed patients, expend the bal-
ance remaining out of said revenues, if any, for
repayment to the general fund of the State treas-
ury of the amount heretofore paid out of said gen-

much thereof as may be necessary, shall be made
available for the satisfaction of a deficit, should

by the Governor, in the funds available for the
fourth quarter of the fiscal year 1941-1942 in the
appropriation “For protection and development
of the forest resources of the State”, in accord-
ance with law.
It is further provided that out of the afore-
said appropriation of $15,790 the first year and
$13,134 the second year, with the consent and
approval of the Governor first obtained, there may
be expended for each year of the biennium “For
the administration and protection of State forests”

struction and reconstruction, of the secondary system

by appropriated not less than thirty per centum of the
funds available to the State Highway Commission in
each year of the biennium ending June 30, 1944, for
maintenance and improvement, including construction
and reconstruction, for both primary and secondary
systems.

deferred until the end of the present national
emergency. Funds for such projects shall not
thereafter be available for expenditure unless and
until the Governor shall certify in writing to the
Comptroller that the payment of such allocations
will not, in the judgment of the Governor, create
or add to a deficit in the highway funds of the
State treasury during the biennium which ends
June 30, 1944, that the labor, materials and other
services or facilities, iftany, required for acquisition
or construction of such additions or betterments
can and will, in the judgment of the Governor, be
obtained at a reasonable cost and that the expendi-
ture of the said allocation will not, in the judg-
ment of the Governor, adversely affect the con-
tinuation and completion of the present program
of arming the State and Nation for national de-
fense and the prosecution of the war. Such
limitations shall not apply, however, to alloca-

Total conditional appropriations out of general fund for
year ending June 30, 1943
2a. For the increased cost of operation of State Institutions of Higher Edu-
cation, which because of the current war, and during this biennium, accelerate, by
offering year-round courses for the instruction of doctors, engineers, scientists and
others whose training will promote the welfare of the State and the United States,
there is appropriated for each year of the biennium, a sum not to exceed $100,000,
to be paid from the general fund surplus. Provided, that the Governor shall re-
lease and make available to such State institutions of higher education when and
as needed, such amounts of this appropriation as will represent the net increased
costs to each institution from the operation of such aforesaid accelerated programs
of study.
3. All of the moneys hereinabove appropriated as shown by the herein-
above contained items are appropriated upon the provisos, terms, conditions,
and provisions above set forth herein and those hereinafter set forth in the
following remaining sections of this act. All appropriations made in any act
passed at this session of the General Assembly shall be construed as subject
to the same provisions and conditions contained in this section, and all such
appropriations, as well as those contained in this act, are hereby declared to
be maximum and conditional appropriations, the purpose being to make the
general fund appropriations payable in full in the amounts named herein, only
in. the event the aggregate revenues to be collected and paid into the general
fund of the State treasury during the biennium for which such appro-
priations are made, are estimated by the Governor to be sufficient to pay
all of the said appropriations payable from the said general fund in full;
otherwise, the said appropriations shall be deemed to be payable in such pro-
portions as the total sum of all appropriations out of the general fund of the
treasury bears to the total amount of general fund revenue estimated as avail-
able from revenues to be collected and paid into the general fund of the State
treasury in the said biennium, but, in the event any reduction in appropriations
is found necessary, such reductions shall be made on a uniform percentage
basis applicable alike to each appropriation made out of the general fund.
The Governor is hereby given the power and authority to examine and
survey the progress of the collection of revenue applicable to the general
fund of the State treasury, out of which the appropriations made by this act
or by any other act are payable, and to declare and determine the amounts
that can during each quarter of each of the fiscal years of the biennium be
properly allocated to each respective appropriation, but all reductions made in
allocations requested by any department, institution, board, commission or
agency, within the amounts contained in their respective appropriations, shall
be uniform in percentage as to all such respective appropriations, provided that
the Director of the Budget shall have authority to so restrict any such quar-
terly allocation as to prevent the expenditure out of any such appropriation of
an amount in any quarter so large as to threaten a deficit in any such specific
appropriation. In making such examination and survey, he may require esti-
mates of the prospective collection of revenues from the Comptroller, the State
Tax Commissioner, the State Corporation Commission and any other revenue
assessing or collecting agency of the State having information which in the

opinion of the Governor may be pertinent. The Governor shall, subject to the
qualifications herein contained, reduce all of said appropriations payable out
of the general fund of the State treasury, made by this. act or by any other
act when, and to the extent, necessary to prevent any expenditure for the pay-
ment of the said general fund appropriations in excess of the revenues col-
lected and paid into the said general fund of the State treasury during
the biennium for which such appropriations are made. Any reduction so made
shall be applied to all fees, charges and commissions, including salaries and
other allowances to local officers and employees, the amount of which is fixed
by or under general law, paid out of the general fund.
However, in applying any such reductions to the appropriations payable
to sheriffs and city sergeants, the cost of food and other articles necessarily
purchased by said sheriffs and city sergeants, in the performance of their offi-
cial duties for the State of Virginia, shall be excluded from the said re-
ductions.
It is further provided that the Governor, in determining the extent to which
revenues estimated to be collected and paid into the general fund of the treasury
during the biennium which ends June 30, 1944, are sufficient for the payment of
general fund appropriations authorized for expenditure during the: said biennium
may exclude from the total of the said general fund appropriations all such
appropriations which in his judgment have been provided for the payment of
expenditures of a non-recurring nature and as such are properly payable from the
general fund surplus. |
In exercising the powers and performing the duties set forth in the pre-
ceding paragraph, the Governor shall in no case reduce the total appropria-
tions made to any one department, institution or agency therein referred to
to any amount less than seventy-five per centum of the total of the original
appropriations.
This section shall not be construed as authorizing any reduction to be
made in the amounts herein appropriated for the payment of interest and
sinking fund installments on the bonded debt of the State government, or for
the payment of a legally authorized deficit, or for the payment of pensions
to Confederate veterans, their widows or dependents, or for the support of
needy Confederate women, or Confederate veterans, or for caring for the
graves of Confederate dead, nor as authorizing a reduction in the salary of
any State officer where such reduction would be contrary to the Constitution
of the State, nor to any appropriation made to enable payments to be made
in fulfillment of any contract for the construction and furnishing of any
State building or supplies incident thereto.
Where necessary to the exercise of the powers and duties conferred on
the Governor by this section, he may enforce such uniform reductions in
the salaries of State officials and employees on a flat or graduated basis as
he may find necessary, provided that any such salary reduction which the
Governor may order or require shall apply to salaries payable from special
funds as well as to salaries payable from the general fund of the treasury (but
not from Federal grants under Title Three of the Federal Socjal Security Act
or Federal grants for maintenance of a public employment service)..

5. The appropriations provided for in this act for making loans to stu-
ients at the several State institutions shall be expended upon such terms and
.ccording to such rules as may be prescribed by the respective governing
yoards of the institutions for which the appropriations are made, in making
oans to needy and deserving students of talent and character from Virginia
‘n said institutions for the purpose of aiding these to obtain an education at
such institutions, who might not be able otherwise to do so. Such loans shall
not exceed $200.00 in any one session to the same student; and they shall be
made to said students upon such terms, as to time and security, as the Comp-
troller shall prescribe; provided, however, that the rate of interest charged
said students on such loans shall not be less than four per centum per annum.
The said State students’ loan funds shall be preserved from depletion by
the said institutions; and together with the repayments and accretions thereto,
shall be held and used for the purpose specified in this act and no other; and
each of said institutions shall annually, not later than July in each year
thereafter, file, in the office of the Superintendent of Public Instruction, a state-
ment, in detail, showing for the year past the amounts received by said funds,
or the loans made, to whom made, and upon what terms, the amount of the
corpus of said funds, the amounts repaid to said funds, and from whom, and
any other information deemed pertinent by the institution so reporting, of
which may have been requested by the Superintendent of Public Instruction.
The Comptroller shall make no payment to any of the said institutions on
account of the said students’ loan funds unless and until the institutions apply-
ing for such payment shall have furnished the said Comptroller a certificate
from the Superintendent of Public Instruction that such institution has com
plied, in all respects, with the foregoing requirements of this act in relatior
thereto.
The Auditor of Public Accounts shall annually audit and exhibit in hi
annual report the account of the said funds at each of the said institutions.
Where the student loan fund created by State appropriation is inadequat
in amount at any institution to carry out fully the purpose for which this fun:
was established, the governing board and president of such institution, with th
written consent and approval of the Governor first obtained, is authorized, fo
the purpose of providing an additional student loan fund, to borrow from suc
sources and on such terms as may be approved by the Governor an amount nc
to exceed $20,000, and to provide for such extensions or renewals of suc
loans as may be necessary. Such fund shall be used only in making loans t
students in the same circumstances and under the same terms and regulation
as are herein prescribed for loans from the fund created by the State appropri
tion, and for no other purpose whatever. The repayments and interest ac-
cretions to said fund shall be used so far as may be necessary to repay the
indebtedness of the institution created by the governing board and presiding
officer thereof, in establishing said additional student loan fund. Such addi-
tional amounts may be borrowed by the governing board and president of the
institution, with the Governor’s approval, from time to time, as may be neces-
ary to maintain the amount of said additional loan fund, whether in cash
or notes receivable or both, including all amounts heretofore borrowed and not
repaid, at $20,000.
Accounts shall be kept and reports rendered for all such additional loan
funds in all respects as herein required for loan funds created by State appro-
priation, and the Auditor of Public Accounts shall annually exhibit in his re-
port the amounts of the said additional loan funds at each institution.
It is hereby provided that the governing board of any State institution for
which a Student Loan Fund has been established may, with the written ap-
proval of the Governor, cancel any indebtedness due such institution on ac-
count of a loan or loans made from such fund when such indebtedness has
been outstanding more than fifteen years, and in the opinion of the president
and governing board of the institution is uncollectible. Upon the cancellation
of any such indebtedness a statement thereof describing the obligation in de-
tail and the date of its cancellation shall be certified by the president at the
institution to the Comptroller.
VIRGINIA STATE SCHOOL FOR THE DEAF AND THE BLIND,
AT STAUNTON
6. The following appropriations provided in chapter 425 of the Acts of
Assembly of 1940 are hereby reappropriated for expenditure by the State in-
stitutions to which such appropriations were made as follows:

‘MEDICAL COLLEGE OF VIRGINIA, HOSPITAL DIVISION
Item 49814
There is hereby reappropriated to the Medical College of Virginia, Hospi-
tal Division, any balance remaining unexpended at the close of business on
June 30, 1942, in the appropriation of $100,000 made by chapter 425 of the
Acts of Assembly of 1940, for equipment for the new hospital building at the
said Hospital Division of the Medical College of Virginia. It is provided,
however, that the unexpended balance herein reappropriated in the said ap-
propriation of $100,000 for equipment for the said hospital building shall not
be available for expenditure unless and until the Governor has certified in
writing to the Comptroller that in his judgment the said appropriation can
be paid out of the current revenues to be collected and paid into the general
fund of the State treasury, during the biennium which ends June 30, 1944,
without creating or adding to a deficit in such current revenues for the said
biennium and that the payment of the said appropriation will not reduce the
general fund surplus.
7. Whereas the office of the Director of State Hospitals, at Rich-
mond, the Central State Hospital, at Petersburg, the Eastern State Hos-
pital, at Williamsburg, the Southwestern State Hospital, at Marion, the
Western State Hospital, at Staunton, and the State Colonies for Epileptics and
Feeble-minded are all under the management and direction of the State Hos-
pital Board, it is expressly provided that the said State Hospital Board is
hereby authorized and empowered, by and with the written approval of the
Governor, whenever in the opinion of said board and of the Governor, the
best interests of the State will thereby be conserved and promoted, to transfer
and deduct from the amounts herein appropriated to any one or more of said
hospitals or institutions for its operation and maintenance, such amounts as
may be deemed proper and add the same to the amounts herein appropriated
for the operation and maintenance of any other one or more of said hospitals
or institutions. In order that a more orderly administration of funds appro-
priated may be effected, the said hospitals or institutions may, with the ap-
proval of the State Hospital Board, readjust the appropriations by transfers
within the major classifications, and between personal service and other
items in the budget.

State Corporation Commission may spend, in addition to the appropriations
herein made, for the supervision, inspection and regulation of concerns con-
ducting an insurance business, any additional revenues paid into the State
treasury from fees or other charges for the supervision, inspection and regula.

15. All monies, fees, taxes and other charges hereafter collected by or on
behalf or on account of the Department of Agriculture and Immigration, in
pursuance of law, from whatever source, or on account of the laws adminis-
tered by the said department, or any division or section thereof, shall be paid
promptly and directly into the general fund of the State treasury. This para-
graph includes the fund known as the hog cholera serum fund, the fund known
as the fertilizer fund, the fund derived from the registration and certification
of nurseries, the funds derived from the licensing and inspection of creameries,
cheese plants, condensed milk plants, ice cream plants, milk distributing plants
and milk and ice cream buying stations, the fund derived under the pro-
visions of the act entitled “An act to regulate the distribution and sale of
milk and cream, to define and fix standards for said milk and cream, to pro-
vide for bio-assays of certain milk, and to provide for the payment for such
assays, and for the disposition of funds collected,” approved March 31, 1938
(Acts of Assembly of 1938, page 671); the funds derived under the provisions
of the act entitled “An act to provide for the inspection of sweet cream
and ice cream mix imported into the State of Virginia,” approved March 31,
1938 (Acts of Assembly of 1938, page 711); and such other special funds as are
hereinbefore described, but does not include the funds derived from the opera-
tion of the State lime grinding plants.
16. All fees hereafter collected for the examination and licensing of mo-
tion picture films publicly exhibited in Virginia, together with all other receipts
from all sources collected for the support of the Division of Motion Picture
Censorship, shall be paid directly and promptly into the general fund of the
State treasury.
17. All fees and charges collected by or on behalf of the Virginia real
estate commission for licensing and regulating real estate brokers and real
estate salesmen, in accordance with the provisions of chapter 461 of the Acts of
Assembly of 1924, or any amendment thereto, shall be paid promptly and di-
rectly into the general fund of the State treasury.
18. It is hereby provided that the military fund be, and the same is
hereby abolished, and monies shall no longer be set aside by the Comptroller
for the said fund. |
19. All revenues and funds heretofore accumulated or hereafter collected
under the provisions of section 15 of an act approved March 30, 1936 (Acts
of Assembly, 1936, page 775), shall be paid directly and promptly into the
general fund of the State treasury.
20. All monies, fees and revenues heretofore accumulated, or hereafter
collected by the State Commission on Conservation and Development by,
from, or through the operation of. State parks, including entrance and con-
cession fees and any and all other funds derived from the operation ar uee

of such parks, shall be paid directly and promptly into the general fund of
the State treasury. -
It is provided, however, that so much of said revenues as are necessary
to pay any appropriations authorized by this act for payment therefrom shalt
be set aside as a special fund for the said purpose.
21. All fees hereafter received or collected by or on behalf of the State
Registrar of Vital Statistics under the provisions of chapter 371 of the Acts
of Assembly of 1924, or any amendment thereto, shall be paid directly and
promptly into the general fund of the State treasury.
22. All monies, fees, taxes and charges hereafter collected by the State
Board for the Examination and Certification of Architects, Professional En-
gineers and Land Surveyors, as authorized by chapter 328 of the Acts of As-
sembly of 1920, as amended, shall be paid directly and promptly into the gen-
eral fund of the State treasury.
23, ~All monies, fees, taxes and charges hereafter collected by the State
Board of Accountancy, as authorized under sections 566 to 571, inclusive, oi

Board of Embalmers and Funeral Directors of Virginia, as authorized under
sections 1715 to 1722, inclusive, of the Code of Virginia, or any amendment
thereto, shall be paid directly and promptly into the general fund of the
State treasury.
26. All monies, fees, taxes and charges hereafter collected by the State
Board of Examiners in Optometry, as authorized under sections 1625 to 1632,
inclusive, of the Code of Virginia of 1919, or any amendments thereto, shall be
paid directly and promptly into the general fund of the State treasury.
27. All monies, fees, taxes and charges hereafter collected by the Board
of Examiners, as authorized by sections 1838 to 1843 of Chapter 150 of the
Acts of Assembly of 1940, shall be paid promptly and directly into the gen-
eral fund of the State treasury.
- 28. All monies, fees, taxes and charges hereafter collected by the State
Board of Examiners of Graduate Nurses, as authorized under sections 1703 to
1714, inclusive, of the Code of Virginia of 1919, as amended, shall be paid di-

It is provided, however, that the provisions of this section shall not apply
o the DeJarnette State Sanatorium, nor to the Industrial Department of the
enitentiary, provided however that the Governor may permit the expendi-
ure by any of said institutions of any such monies, fees and revenues so
ollected and paid into the State treasury by the said institution for a material
xpansion of the activities of the said institution, where in the judgment of
he Governor such expenditure will result, within a period of twelve months
rom the granting of such permission by the Governor, in the repayment to
he State treasury by the said institution of an equal or larger amount than
the monies so expended, and provided further that the Governor may au-
thorize or direct, on such terms and conditions as he may prescribe, the
‘rransfer of surplus farm commodities produced at any one of the said in-
titutions named in this section to any other of the said institutions.
39. The appropriation in this act of a specific amount for the examina-
tion of the accounts of local governmental units shall not be construed as pro-
hibiting the examination or audit, by the Auditor of Public Accounts, of the
books or records of any county, city or other political subdivision, or any
officer or agency thereof, of this State, the cost of which audit or examination
is required by existing laws to be borne by the said county, city or othe
political subdivision, and the Auditor of Public Accounts is hereby authorized
with the written consent and approval of the Governor first obtained, to mak«
such expenditures, in addition to the specific appropriation made in this ac
for the examination of the accounts of local governmental units, as may b
necessary to give effect to this provision.
40. With the written consent and approval of the Governor first ob
tained, any department, institution or other agency of the State governmer
may expend, in addition to the appropriation herein made to such departmen
institution or agency, any money, revenue OF funds paid into the State treas
ury to the credit of said department, institution or agency, in excess of suc
appropriations as proceeds of donations, gifts or Federal grants, when late
developments are believed to make such expenditure necessary, such expend
ture to be in accordance with the purpose for which said gift, grant or don
tion was made.
41. Any amount paid to any department, institution or other agency |
the State government as proceeds of an insurance policy may be expended |
replace any property loss covered by such policy and is hereby appropriate
for expenditure as far as may be necessary, to make such replacement pri
vided, however, that the Governor’s written approval shall first be obtaine
for any such expenditure of the proceeds of an insurance policy in excess <
$2,500.00.
42. It is hereby Provided that no public funds or money shall be e>
pended by any State institution of higher learning to which an appropriatio
is made by this act, for the purpose of paying for advertisements or advertis
ing intended or designed to promote student attendance, at any such in
stitution.

44. Every appropriation set forth in the foregoing provisions of thi
act for any State institution and made payable from the general fund of th
such institution; each such appropriation shall be reduced by the Governo;
insofar as the same is not so required.
45. No expenditures for printing, ruling, lithographing, and binding
annual reports or for printing, ruling, lithographing and binding any other
ublications, forms or material of any description of or for The Virginia State

46. Before distributing to the counties and cities of the State the

47. It is further provided that from the revenues collected and paid into
the treasury, by county and city treasurers, clerks of courts and delinquent
tax collectors, or, other collecting officers, creditable to any fund or funds
other than the general fund of the Commonwealth, the cost of collecting
which has been paid from an appropriation out of the general fund of the
Commonwealth, the Comptroller shall deduct the amount of cost of such
collections and credit the same to the general fund of the Commonwealth to
reimburse that fund for the expense paid therefrom.
- 48. The Virginia School for the Deaf and the Blind at Staunton, shall
reimburse monthly the Western State Hospital, at Staunton, for steam fur-
nished the said School for the Deat and the Blind by the said Western State
Hospital at a rate per thousand pounds of steam so furnished, to be fixed by
the Director of the Division of the Budget with the approval of the Gov-
etnor. Such rate shall include the actual cost of the production of such steam,
by the Western State Hospital, as determined by the supervisor of State
power plants, including in the said production cost all operating expenses,
depreciation on heating plant buildings and equipment and interest on the
amount invested therein. The amount received by the Western State Hos-
pital from the said Virginia School for the Deaf and the Blind, under this
section, shall be credited by the Comptroller to the appropriation for the
Western State Hospital as a refund on the cost of fuel purchased by the said
hospital.
49. The Comptroller is hereby directed to transfer to the general fund
of the State treasury for each fiscal year of the biennium which begins July
1, 1942, and ends June 30, 1944, from the respective appropriations made by
this act, to the Industrial Commission of Virginia, to the State Boxing and
Wrestling Commission, and to the Milk Commission, an amount equivalent
to the annual rental payment obtained by charging each of the said depart-
ments or agencies for the average amount of floor space which they occupy
during each of said years in buildings in the Capitol Square at Richmond
at the annual rate of $1.75 per square foot for office floor space and fifty cent:
per square foot for storage floor space.
It shall be the duty of the Director of the Division of Grounds an
Buildings to report to the Comptroller on June 30th and December 31st i:
each of said fiscal years the average number of square feet of office floo
space and storage floor space occupied by each of said departments o

the sum of $261,685 shall be transferred from the proceeds of the motor
vehicle fuel tax to the general fund of the State treasury on January 1, 1943,
and the sum of $245,735 shall be transferred from the proceeds of the motor
vehicle fuel tax to the general fund of the State treasury on January 1, 1944.
In order to reimburse the general fund of the State treasury for expenses
herein authorized to be paid out of the said general fund for certain activities
of the State Corporation Commission, designated respectively as administration,
assessment and taxation of public service corporations, rate regulation, and
regulation of heat, light and power, water and telephone companies, the sum
of $7,600 shall be transferred on January 1, 1943, and $7,780 on January 1,
1944, from the unappropriated surplus in the fund for making appraisals and
valuations of certain classes of public service corporations for rate making pur-
poses, to the general fund of the State treasury, and the sum of $3,200 shall
be transferred on January 1, 1943, and the further sum of $3,200 on January
1, 1944, from the funds collected and paid into the State treasury under the
provisions of Chapter 360 of the Acts of Assembly of 1932, as amended, Chapter
396 of the Acts of Assembly of 1934, and Chapter 129 of the Acts of Assembly
of 1936, to the general fund of the State treasury.
53. Allowances out of any of the appropriations made in this act by any
and all of the State institutions, departments, bureaus and agencies to any
of their officers and employees for expenses on account of the use by such offi-
cers and employees of their personal automobiles in the discharge of their offi-
cial duties shall not exceed five cents per mile of actual travel.
54. No automobile of the pleasure type shall be purchased by the State
or any officer or employee on behalf of the State costing more than one thou-
sand ($1,000) dollars without the written approval of the Governor first ob-
tained. This provision, however, shall not apply to automobiles purchased by
or for the use of the Governor of Virginia. The Governor is hereby authorized
tv transfer surplus motor vehicles among the departments, institutions and
agencies, and the Director of the Division of Purchase and Printing shall deter-
mine the value of such surplus equipment for the purpose of maintaining th
financial accounts of the departments, agencies and institutions affected by sucl
transfers. The Governor shall promulgate such rules and regulations regarding;
the custody, care, maintenance and use of motor vehicles owned by the Stat
as to him may seem necessary and desirable for the protection of State property
which rules and regulations shall be observed and conformed to by the severa
departments, agencies, institutions, officers and employees involved.
55. Travel, whether by common carrier, or privately owned or for hire«
conveyance, shall be over the most direct practicable route and allowances fo!
travel, except as authorized by the next preceding section, shall not be certifiec
to the Comptroller for payment by agencies of government for amounts ex.
ceeding the standard common carrier rates between points traveled except ir
an emergency (which emergency shall be stated in the expense account), or
when, in the interest of the State, a greater expense is justified, the facts ir
each such instance to be stated in the expense account.
_ 56. All travel expense accounts shall be submitted on forms prescribed
or approved by the Comptroller. Each account shall show the dates expenses
were incurred or paid; points between which traveled; number of miles traveled
when claim for reimbursement for mileage is made; method of travel, whether
by railroad, steamship, bus or, for hire, privately owned or State owned auto-
mobile; pullman fare, to be shown separate from regular fare; hotel expense;
meals; incidental expense, such as telegrams, telephone calls, etc., to be specified
in each instance; a concise statement of the purpose of or reason for such
travel expense. The Comptroller is specifically directed to withhold the issuance
of warrants in payment of expense accounts submitted for “lump sum” amounts.
Provided that nothing in this section is to be construed as prohibiting the
Governor from making rules and regulations providing for payments as. “per
diem” in lieu of actual expenses for lodging, meals and necessary gratuities where
it has been previously determined to the satisfaction of the Governor that the
“per diem” allowed is not in excess of average daily actual expenses of the
traveler for lodging, meals and necessary gratuities, or in excess of. $5.00 per
day, whichever is the lower. oe : "
57. All public revenues received into the State treasury within the two
uppropriation years provided for in this act (with the exception of the reve-
nues segregated by law to special purposes), and the balance of the appropria-
tions payable out of the general fund of the State treasury, made by previous
acts of the General Assembly unexpended at the close of business on the thir-
Heth day of June, 1942, which unexpended balances, except as herein other-
wise provided, are hereby declared to be lapsed into the State treasury, are
1ereby designated the general fund of the State treasury of the Commonwealth
of Virginia, and shall be used for the payment of the appropriations therefrom
wrovided for in this act, subject to the limitations and upon the conditions set

58. No State department, institution or other agency receiving appropria-
ions under the provisions of this act shall exceed the amount of ite annraneia.

boards, who shall have: voted therefor—shall be personally liable for the full
amount of such unauthorized deficit, and, in the discretion of the Governor, shall
be deemed guilty of neglect of official duty, and be subject to removal therefor.
— §9. .Any amount which a State department, institution or other State agency
may expend in excess of its appropriation, under authority given by the Gov-
ernor under this act to such department, institution or other State agency to
exceed its appropriation or to incur a deficit, shall be first obtained by the
said department, institution or agency by borrowing said amount on such terms
and from such sources as may be approved by the Governor and the State
Treasurer. :
| 60. It shall not be lawful for the Comptroller to pay any State department,
institution or other agency any money, except as is provided for in this act, or
in pursuance. of some act of the General Assembly making special appropria-
tions therefor. —
61. The proper officer of each State department, institution or other agency,
for which appropriations are made, shall, in his annual report, give an itemized
account ‘of all éther sums received by such department, institution, officer or
other agency from any other source, and such reports and accounts shall embrace
‘the expenditure of all such funds; which reports shall be forwarded to the
General Assembly and laid before both houses at each session thereof.
... -62;:,None of the monies mentioned in this act shall be expended for any
other purpose than those for which they are specifically appropriated, and it
shall be the duty of the Governor, as chief budget officer of the State, or his
‘deputy, to see that this provision is strictly ‘observed; and should he find that
‘the said monies are not being expended in accordance with the provisions of
‘this act, or that the expenditures under any appropriation included in this
act are in excess of the amount necessary to carry out the purpose for which
‘said ‘appropriation was made, he ‘is hereby given the power to restrain the
‘Comptroller from. making further disbursements, in whole or in part, out o!
“said appropriations, to ‘the offending State, department, institution, officer ot
‘other agency, receiving appropriations under the provisions of this act, pro-
vided, however, that the severa] appropriations made by this act. may not only
“he used for the purposes specified in this act, but authority is hereby given tc
the governing board of any State department, institution or other agency, or
if there. be. no governing board, to- the head of such department, institu-
tion or other agency named in. this. act, to transfer, within. the. respective
department, institution or other agency, any such appropriations from the ob-
ject for which specifically appropriated or set aside to some other object deemed
‘more necessary in view of later developments, subject, however, in every
case; to. the consent and approval of the Governor, in writing, first obtained;
and provided, that the total amount appropriated to the respective department,
¢nstitution or other agency shall in no case be exceeded; and, further provided,
that should such appropriation be withheld by the Governor from any State
department, institution, officer, or other. agency, named in this act, or should
transfers be authorized by the Governor, as herein provided, a copy of the Gov-
ernor’s order in each case setting forth the reasons for withholding said -ap-
propriations or for authorizing the transfer of said appropriations, as the case
may be, shall be preserved in the office of the Governor or the Division of the
Budget and kept open for public inspection. :
- It is further provided, however, that any State institution may, with the
written consent and approval of the Governor first obtained, spend, in addi-
tion to the amount herein appropriated, out of the special revenues of such
institution, any additional special revenues paid into the State treasury to the
credit of such institution, where later developments are believed to make such,
additional expenditure necessary.
_ 63, No appropriation made by this act to any society, institution, board,
association or agency not owned or controlled by the State of Virginia, shall
be expended except. with the consent and approval of the head or governing
board of the State department or institution herein designated, to supervise
said expenditures. The payrolls or bills presented to the Comptroller for said
expenditures shall be itemized and classified, in accordance with the budget
classification adopted by the Governor, and shall be countersigned by the head
or executive officer of said State department or institution, designated for such
purpose, and lump sum ‘transfers of appropriations to the ‘aforesaid agencies
are hereby prohibited. It shall be the duty of each of said societies, institu-
tions, boards, associations, and agencies to submit its biennial budget estimates
to the head or executive officer of said State department or institution, for
‘examination and approval, who shall, after final examination of said esti-
mates, transmit the same to the Director of the Division of the Budget, with
such recommendations as may be considered necessary or advisable. The ac-
counts of each of the said societies, institutions, boards, associations, and agen-
cies ‘shall be subject to audit by the Auditor of Public Accounts, at the direction
of the Governor. —
It shall be the duty of the Comptbotier | to exercise, as herein required,
control and supervision over the expenditures. and ail estimates of the
Confederate memorial associations.
‘It shall be the duty of the State Librarian to exercise, as herein required,
subject. to the approval of the library board, control and supervision over the
expenditures and budget estimates of the Confederate museum at Richmond,
the Confederate Memorial Institute (Battle. Abbey) and the Robert E. Lee
Memorial Foundation, Incorporated. —
It shall be the duty of the Superintendent of Public Instruction to exer-
cise, as herein required, subject to the approval of the State Board of Educa-
tion, control and supervision over the expenditures and budget estimates of
the Cooperative Education Association, and the Virginia Branch of the National
Congress of Parents and Teachers and the Negro Organization Society, Incor-
porated.
It shall be the duty of the Commissioner of Agriculture and Immigration
to exercise, as herein required, subject to the approval of the State Board of
Agriculture and Immigration, control and supervision over the expenditures and
budget estimates of the Virginia State Fair Association and the Virginia State
Horticultural Society.
It shall be the duty of the Director of the Extension Division of the Vir-
ginia Agricultural and Mechanical College and Polytechnic Institute to exercise,
as herein required, control and supervision over the expenditures and budget
estimates of the Certified Seed Commission, the Virginia State Dairymen’s
Association, and the Virginia State Poultry Federation.
It shall be the duty of the Director of the Virginia Truck Experiment
Station to exercise, as herein required, control and supervision over the ex-
penditures and budget estimates of the Association of Virginia Potato and
Vegetable Growers.
| It shall be the duty of the Commissioner of Public Welfare to exercise,
as herein required, subject to the approval of the State Board of Public Wel-
fare, control and supervision over the expenditures and budget estimates of the
Home for Needy Confederate Women, the several travelers’ aid societies receiv-
ing appropriations from the State of Virginia and the Virginia Home for
Incurables.
64. Any funds which may be made available to the Commonwealth of
Virginia under the terms of the Federal Employment Stabilization Act of
1931, as amended, shall be expended under the direction and control of the
Director of the Division of the Budget. 3
65. All the appropriations herein made out of the general fund of the
State treasury for the two years ending, respectively on June 30, 1943, and on
June 30, 1944, unexpended on the books of the Division of Accounts and
Control at the close of business on June 30, 1944, shall, except as herein
otherwise expressly provided, revert to and become a part of the general
fund of the State treasury of the Commonwealth of Virginia, and shall not
‘thereafter be paid by the Comptroller and the same shall be charged off upon
the books in his office, provided, however, that such unexpended balances
‘shall be continued in force for such period not to exceed ten days from June
30, 1944, as may be necessary in order to permit the payment of any claims,
demands or liabilities incurred prior to June 30, 1944, and unpaid at the close
‘of business on that date and shown by audit in the Division of Accounts
and Control to be a just and legal charge against any such unexpended
‘balance. In case the expenditures or indebtedness incurred at any institution
receiving funds under this act, shall exceed the amount appropriated without
legal authority, the Comptroller is hereby directed to make public such over-
draft, and the Director of the Budget is hereby directed to set out the same
in the next budget giving detailed information as to the obligations involved,
whether the overdraft be legal or not. Each and every public officer handling
any State funds shall, within thirty days after the State Corporation Commis-
sion calls for financial statements by State banks, make a detailed statement,
under oath, of the financial condition of his office as of the date of such call,
to the Auditor of Public Accounts, and upon such forms as shall be pre-
scribed by said Auditor of Public Accounts.
66. If any part or parts, section, sub-section, sentence, clause or phrase
of this act is for any reason declared unconstitutional, such decision shall not
affect the validity of the remaining portions of this act which shall remain in
force as if such act had been passed with the unconstitutional part or parts,
section, sub-section, sentence, clause or phrase thereof eliminated; and the
General Assembly hereby declares that it would have passed this act if such
unconstitutional part or parts, section, sub-section, sentence, clause or phrase
had not been included herein.
67. All acts and parts of acts inconsistent with the provisions of this
act be, and the same are hereby, repealed.
68. This act shall become effective on July 1, 1942.
