Chap. 467.—An ACT to authorize and empower the board of supervisors of any
county adjoining any city within this State having a population of more than
190,000, and the board of supervisors of any county having an area of more than
1,000 square miles and a population of more than 60,000, all according to the
last preceding United States census, to provide and operate bus and transporta-
tion lines within such county and into any adjoining city; to avail itself of any
bus or busses or vehicle owned by the county or county school board of such
county; to employ the necessary operators, clerks, dispatchers, repairmen and
other services, including guaranty and liability services, for the operation and
maintenance of such bus and transportation lines; to empower the State Cor-
poration Commission to regulate the operation of said bus and transportation
lines; to appropriate from any fund under control of any such board of super-
visors money for the purchase, maintenance and operation of such bus and
transportation lines and to lay a levy in such county for the purpose of raising
any necessary funds for such purpose. [fH B 543]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. The board of supervisors of any county adjoining any
city within this State having a population of more than one hundred and
ninety thousand, and the board of supervisors of any county having
an area of more than one thousand square miles and a population of
more than sixty thousand, all according to the last preceding United
States census, shall be and it hereby is authorized and empowered to
operate bus and passenger transportation lines as common carriers by
motor vehicles operating under certificate of public convenience and
necessity within such county and into any adjoining city with the consent
of the council of such city and upon such terms and conditions as it may
require for the purpose of transporting persons.
Section 2. Said boards shall have the following powers and duties
subject to the conditions and limitations hereinafter prescribed.
(a) To take over and use any bus or busses or vehicles owned by
the county or county school board of such county for the purposes
herein authorized.
(b) To acquire by purchase, lease or gift such busses, and other
vehicles as it may determine to be necessary for the operation of the
bus and passenger transportation line or lines authorized by this act and
approved by the State Corporation Commission as hereinafter provided.
(c) ‘To employ all necessary operators, clerks, dispatchers, repair-
men and other services, including guaranty and liability services, for the
operation and maintenance of such bus and transportation lines.
(d) ‘To appropriate from any fund under control of such board
of supervisors money for the purchase, maintenance and operation of
such bus and transportation lines, and to lay a levy in such county for the
purpose of raising any necessary funds for such purpose. The net
revenue from the operation of such bus and transportation lines shall be
paid into the General County Fund for appropriation to any fund ap-
propriated from to the extent of such appropriation for the purposes
of this act. After any such fund has been so restored then all revenue
derived from the operation and maintenance of such bus and transporta-
tion lines shall be placed in the General Fund of the county, from which
fund the board shall appropriate such sums as it deems necessary for
the operation and maintenance of the bus and transportation lines author-
ized. After the discontinuance of the bus and transportation lines herein
authorized, the board may credit (after satisfying all claims on account
of said operation of such lines), the net revenue then remaining to any
general county fund and appropriate the same to any county purpose.
Section 3. The State Corporation Commission is hereby authorized
and empowered to grant a certificate or certificates to any such board
of supervisors, upon the Commission’s determination that a necessity
for any such bus and transportation lines exists. The said State Cor-
poration Commission shall, in its consideration of the application which
may be filed by any such board for a certificate of necessity, consider
the temporary necessity because of the emergency created by the state
of war now existing.
The said Commission shall grant any such board the right to dis-
continue the operation of any such bus and transportation lines upon
the application of any such board to so discontinue the same.
The said Commission shall regulate the operation of any such bus
and transportation lines as is provided by general law, for regulation
of other bus and transportation lines.
This act shall be effective only during the period of the present
emergency created by the war in which this country is now engaged.
Section 4. Nothing in this act shall be construed to authorize or
permit such board of supervisors to operate a local passenger bus service
within the corporate limits of any such city.
