Chap. 461.—An ACT to amerid and re-enact Section 6, as heretofore amended, of an
act entitled “An act to afnend and re-enact the charter of the town of Culpeper.”,
approved January 11, 1, 2898, e said section relating to the officers of the town
and their terms of office, so/as to provide that the treasurer of the town shall be
appointed by the council fen such plan of appointment has been approved by
the qualified voi the town, and to provide for a referendum a such

1. Be it enacted by the General Assembly of Virginia, That section
six, as heretofore amended, of an act entitled “An act to amend and re-
enact the charter of the town of Culpeper.”, approved January eleventh,
eighteen hundred and ninety-eight, be amended and re- -enacted, as
follows 7
Section 6. The present officers of the town shall continue in office
until the expiration of the term for which they were elected unless sooner
removed as provided by law.
At the regular election to be held for the election of officers for the
Town of Culpeper on the second Tuesday in June, nineteen hundred and
thirty-six, there shall be elected from the qualified voters of the Town of
Culpeper, a recorder whose term of office shall be for a period of two years
beginning the first day of September, nineteen hundred and thirty-six;
and five councilmen whose term of office shall be for a period of four
years beginning the first day of September, nineteen hundred and thirty-
six. At said election the five persons receiving the highest number of votes
for councilmen shall be declared elected. The said five councilmen so
elected together with the present four councilmen whose term of office
expires on the thirty-first day of August, nineteen hundred and thirty-
eight, shall constitute the council of the Town of Culpeper until their
successors are elected and qualify, as herein provided. At the regular
election to be held in the Town of Culpeper on the second Tuesday in
June, nineteen hundred and thirty-eight, for the election of officers ; there
shall be elected from the qualified voters of the town a recorder whose
term of office shall be for a period of two years beginning the first day of
September next following ; and four councilmen. The said four councilmen
shall be elected in the place and stead of the present four councilmen
whose terms of office expire the thirty-first day of August, nineteen hun-
dred and thirty-eight. The terms of office of the four councilmen so
elected shall be for a period of four years beginning the first day of Sep-
tember, nineteen hundred and thirty-eight ; and thereafter at the regular
election to be held in the Town of Culpeper biennially, on the second
Tuesday in June, there shall be elected a recorder whose term of office
shall be for a period of two years beginning on the first day of September
following said election; and also five and four councilmen, respectively,
as their terms of office expire, whose terms of office shall be for a period
of four years beginning the first day of September following said election.
Upon the expiration of the term of office of the treasurer who is in
office at the time this amended section becomes effective, the council shall
appoint a town treasurer who shall hold office during the pleasure of the
council and whose duties shall be those prescribed in this charter, together
with such other duties as may be imposed by the council. Such treasurer
shall have all the powers conferred upon the town treasurer by this
charter, and he shall receive such compensation as shall be fixed by the
council.
2. Beit further enacted by the General Assembly of Virginia, That
the foregoing amendments to section six of the charter of the Town of
Culpeper shall not become or be effective unless and until the same be
approved by a majority of the qualified voters of the said town voting on
the question at a special election called and held for the purpose. Such
election shall be called and held at any time upon the petition of fifty or
more qualified voters of such town or upon the petition of the town
council, filed with the circuit court of the county of Culpeper, or with the
judge thereof in vacation. The said court, or the judge thereof in vacation,
shall by order entered of record, require the regular election officials on
the day fixed in the said order to open a poll and take the sense of the
qualified voters of the town on the question submitted as herein provided.
The ballots therefor shall be provided, distributed and voted, the election
conducted by the regular election officers, and the result thereof ascer-
tained and certified, in accordance with the provisions of section ore
hundred and ninety-seven-a of the Code of Virginia. If a majority of the
votes. cast on the question be in favor of. having the town treasurer ap-
pointed by the council, section six of the charter of Culpeper, as amended
by this act, shall become effective upon the determination of such fact by
the commissioners of election. If a majority of such votes cast be against
the appointment of the town treasurer by the council, the said’ section-as

_ 3. An emergency existing, the next preceding section (numbered
“2” and providing for an election and the effect thereof) of this act is, for
the purposes therein set forth, in force from the passage of this act.
