Chap. 447.—An ACT to amend and re-enact Section 13 of Chapter 385 of the Acts
- of the General Assembly of 1932, approved March 29, 1932, and therein desig-
nated as the Virginia Operators’ and Chauffeurs’ License Act, relating to
issuance and revocation of licenses, and prescribing penalties. [H B 490]

1. Beit enacted by the General Assembly of Virginia, That section
thirteen of chapter three hundred and eighty-five of the Acts of the
General Assembly of nineteen hundred and thirty-two, approved March
twenty-ninth, nineteen hundred and thirty-two, and therein designated as
the Virginia Operators’ and Chauffeurs’ License Act, be amended and
re-enacted as follows:
Section 13. Licenses issued to operators and chauffeurs.—(a)
The Division shall issue to every person licensed as an operator an oper-
ator’s license and to every person licensed as a chauffeur a chauffeur’s
license. Any person licensed as a chauffeur under this act shall not be
required to procure an operator’s license, but no person shall drive any
motor vehicle as a chauffeur unless licensed as a chauffeur.
(b) Every such license shall bear thereon the distinguishing num-
ber assigned to the licensee and shall contain the name, age, residence
address and a brief description of the licensee for the purpose of identifi-
cation, also a space for the signature of the licensee.
(ce) The division may, in its discretion, issue to every person
licensed as a chauffeur a chauffeur’s badge, or may refrain from issuing
to any person such badge. In the event a chauffeur’s badge is issued it
shall be of metal with a plainly readable distinguishing number assigned
to the licensee stamped thereon.
(d) The division, upon determining after an examination that an
applicant is mentally, physically and otherwise qualified to receive a
license, may issue to such person a temporary driver’s permit entitling
such person while having such permit in his immediate possession to drive
a motor vehicle upon the highways for a period of thirty days before
issuance to such person of an operator’s or chauffeur’s license.
(e) The division upon issuing an operator’s or chauffeur’s license
shall have authority, whenever good cause appears, to impose restrictions
suitable to the licensee’s driving ability with respect to the type of, or
special mechanical control devices required on, a motor vehicle which the
licensee may operate, or such other restrictions applicable to the licensee

as the division may determine to be appropriate to assure the safe opera-
tion of a motor vehicle by the licensee. , 3
(f) Any person issued an operator’s or chauffeur’s license or
which there is printed or stamped restrictions as provided by this section
and who operates a motor vehicle in violation of such restrictions shall
be guilty of a misdemeanor and upon conviction shall be punished as
provided in section twenty-nine of this act, and in addition thereto the
division, upon receiving notice of such conviction, shall immediately
suspend the operator’s or chauffeur’s license of such convicted person,
and such suspension shall remain in force and effect until the provisions
of this section have been complied with. 3
(g) The division having good cause to believe that a licensed
operator or chauffeur is incompetent or otherwise not qualified under this
act to be licensed, may, upon written notice of at least five days to the
licensee, require him to submit to an examination. Upon the conclusion
of such examination, the division shall take such action as may be appro-
priate, and may suspend or revoke the license of such person or permit
him to retain such license, or may issue a license subject to such restric-
tions as are authorized to be imposed by this section. Refusal or neglect
of the licensee to submit to such examination or comply with such restric-
tions shall be grounds for suspension or revocation of his license.
