Chap. 221.—An ACT to create the Princess Anne-Virginia Beach Incineratos

Commission and to prescribe the powers, functions and duties of the Commissior

1. Be it enacted by the General Assembly of Virginia, as follows

Section 1. A commission is hereby created for the county of Prin.
cess Anne and the town of Virginia Beach, to be known as the Princes:
Anne-Virginia Beach Incinerator Commission, which shall be composec
of the members of the board of supervisors from Lynnhaven and Kemps:
ville Magisterial districts of Princess Anne county, the treasurer of th
said county, the mayor of the town of Virginia Beach, the chairman o
the Health Committee of the town council of Virginia Beach and th
treasurer of the town of Virginia Beach. The judge of the circuit court 0
the county of Princess Anne shall appoint a citizen of the said county o
town who shall have the right to vote as a member of the Commission 11
case of a tie vote among the regular members. The said Commission shal
be a body corporate invested with the rights, powers and authority ans
charged with the duties set forth in this act. The Commission may elec
one of its members as chairman and may appoint such other officers anc
agents as it may require. A majority of the members of the Commissiot
shall constitute a quorum.

Section 2. The Princess Anne-Virginia Beach Incinerator Com
mission hereby created shall have all the powers necessary or convenien
to carry out the purposes for which it is created, including the following
powers in addition to others herein granted: !

(a) To sue and be sued; to have a seal and to alter the same at
pleasure; to have perpetual succession; to make and execute contract:
and other instruments necessary or convenient to the exercise of the
powers of the Commission ; and to make and from time to time to amend
and repeal by-laws, rules and regulations, not inconsistent with law, tc
carry out the general purposes of the Commission.

(b) To acquire by purchase, lease, gift or otherwise, and to main-
tain and operate for the said county of Princess Anne and town of Vir-
ginia Beach any incinerator, incinerator plant or project, or garbage and
waste disposal system necessary or suitable for the use of the said county
or town or any part thereof, and to provide for the construction, recon-
struction, improvement, alteration or repair of any such plant, system or
project or any part thereof.

(c) To contract with any person, firm or corporation for the pur-
pose, and to dispose of garbage, waste and other refuse and to make proper
charges therefor.

(d) To operate for the joint use of the said county and town an
incinerator plant recently acquired for the purpose and now located near
the town of Virginia Beach, and to do all things necessary and proper
in the maintenance and operation of such plant.
