Chap. 137.—-An ACT to amend and re-enact Sections 2, 3, 9, 17, 53, 54 and 55 of
Chapter 217 of the Acts of the General Assembly of 1918, approved March 14,
1918, which chapter provides a new charter for the City of Clifton Forge, said
sections relating to the mayor and council and other city officers; to amend said
charter by adding thereto three new sections numbered fifty-three-a, fifty-
three-b, and fifty-three-c, providing for the appointment of a trial justice, a
substitute trial justice, and a trial justice’s clerk, and prescribing their jurisdic-
tion, powers and duties; and to repeal Sections 5, 10, 11, 12, 13, 14, 15, 16, 18,
22 and 52 of said charter. [fH B 203]

1. Beit enacted by the General Assembly of Virginia, That sections
two, three, nine, seventeen, fifty-three, fifty-four and fifty-five of Chapter
two hundred and seventeen of the Acts of the General Assembly of nine-
teen hundred and eighteen, approved March fourteenth, nineteen hundred
and eighteen, be amended and re-enacted, and that said charter be
amended by adding thereto three new sections numbered fifty-three-a,
fifty-three-b, and fifty-three-c, which amended and new sections are as
follows:
Section 2. Government——The government of the City of Clifton
Forge shall be vested in a council and city manager appointed by said
council, as provided by law and such boards and officers as are permitted
and required by law, and as may be constituted and appointed by said
council. The city manager shall have the authority, powers and duties
as are provided by the general laws of the State of Virginia.
Section 3. The municipal officers of the said city shall consist of
five councilmen, a treasurer, a clerk of the circuit court of said city, an
attorney for the Commonwealth, a sergeant, a commissioner of the Reve-
nue.
Section 9. Mayor.—There shall be elected by the five councilmen, a
mayor who shall be one of the said five councilmen, and who shall possess
only those powers vested in him by the general laws under the city
manager plan of government.
Section 17. City Council—There shall be elected by the qualified
voters of the city on the second Tuesday in June, nineteen hundred and
forty-two, five councilmen to be elected at large and to serve terms as
now provided by section twenty-nine hundred and thirty-two of the
Code of Virginia, except that instead of drawing lots to determine who
of the council shall serve terms of two years and four years, it shall be
determined that the three councilmen receiving the highest number of
votes at the said election shall serve for a term of four years, and a
councilmanic election shall be held on the second Tuesday in June of
each second year thereafter as provided in said section. All councilmen
elected at the regular June election shall take office on the first day of
September following such election.
Section 53. Justices of the peace——There shall be elected by the
qualified voters of each ward, on the Tuesday after the first Monday in
November, nineteen hundred and forty-five, and every four years there-
after, one justice of the peace for each of the three wards of the said
city. These justices of the peace shall have no authority to try any civil
or criminal cases on or after September first nineteen hundred and
forty-two, but shall only be issuing justices as provided by law and they
shall perform such duties as are required of them by section forty-nine
hundred and eighty-seven-f of the Code of Virginia.
Section 53-a. On or before the first day of September, nineteen
hundred and forty-two, for the City of Clifton Forge, Virginia, there
shall be appointed for a term of four years, beginning September first,
nineteen hundred and forty-two, and every four years thereafter, by the
Circuit Court of the City of Clifton Forge, Virginia, or the judge thereof
in vacation, a trial justice, who shall be a resident of said city. The said
trial justice shall, in civil matters within the limits of said city and in
criminal matters within the limits of the city and for one mile beyond,
have and possess the same powers, authority and jurisdiction as are now,
or may hereafter be, vested by general law in the trial justices of the
various counties, within their counties. The salary of such trial justice
shall be such as the council may hereafter designate by ordinance; and
all general laws which are now or may hereafter be applicable to trial
justices of the various counties, shall be applicable to the said trial justice
of Clifton Forge.
Section 53-b. On or before September first, nineteen hundred and
forty-two, the Circuit Court for the City of Clifton Forge, or the judge
thereof in vacation, shall appoint a substitute trial justice and may at any
time revoke such appointment, and may make a new appointment in the
event of such revocation, or of the death, absence or disability of such
substitute trial justice. In the event of the inability of the trial justice to
perform the duties of his office, by reason of sickness, absence, vacation,
interest, proceedings before his court, or otherwise, such substitute trial
justice shall perform the duties of the office during such inability and
shall receive for his services a per diem compensation equivalent ‘to one-
twenty-fifth of the monthly installment of the salary of the trial justice,
which, in the discretion of the city council may be deducted from the
salary of the trial justice, except that no deduction shall be made on
account of a vacation period, such as is provided for in the general laws;
and said substitute trial justice shall have and possess the same powers,
authority and jurisdiction as are now, or may hereafter be, vested by
general law in the substitute trial justices of the various counties, within
their counties, and all general laws which are now applicable or may
hereafter be applicable to the substitute trial justices of the various
counties shall be applicable to the said substitute trial justice of the said
City of Clifton Forge.
Section 53-c. The trial justice may appoint a clerk who shall have
and possess the same powers, authority, jurisdiction and duties, as are
iow, or may hereafter be, vested and designated by general law, Dut No
uch appointment shall be made by any trial justice until the city council
yf the City of Clifton Forge shall authorize the appointment of a clerk
ind shall fix the salary of such clerk.
Section 54. The city manager shall appoint a chief of police and
uch other police officers as may be necessary. The said city manager
shall have the supervision and control of the police of the said city,
srovided, however, that an appeal may be taken from any ruling of the
ity manager concerning said police to the council of the said city. The
salary of the chief of police and the police officers shall be fixed and
Jetermined by the council of said city.
Section 55. The city auditor—The city council may in its dis-
‘retion every two years at the stated September meeting, following the
-egular election of councilmen in the preceding June election, elect one
sity auditor, whose duties and compensation shall be as fixed by the
council. :
2. Be it further enacted, That sections five (5), ten (10), eleven
(11), twelve (12), thirteen (13), fourteen (14), fifteen (15), sixteen
(16), eighteen (18), twenty-two (22), and fitty-two (52) of chapter
-wo hundred and seventeen of the Acts of the General Assembly of
nineteen hundred and eighteen, approved March fourteenth, nineteen
hundred and eighteen, are hereby repealed.
