Chap. 56.—An ACT for the Relief of Madison Allen.

Whereas, by an act of the general assembly, passed Febru
ary fourteenth, eighteen hundred and forty-eight, the Walker’
Creek and Holston Turnpike Company was incorporated, witl
a capital stock of twenty-six thousand dollars, fifteen thousan
six hundred of which was subscribed by the state, and the
residue thereof by private incorporators, the said road, except
about one mile thereof, was let to contract and made according
to the provisions of said charter; and whereas, one Madison
Allen undertook to make the said uncompleted mile of said
road for the sum of one thousand dollars. and eompleted at
least four fifihs of the same, and then ascertamed that the
funds for the building of said road had been exhausted, and
therefore suspended the completion of the same until further
provisions should be made; and whereas, the said Madison Al-
len had agreed to take stock in said company to the amount of
two hundred dollars, and had executed his bond to the said
company for that amount; and whereas, a judgment has been
obtained by the creditors of said company against the said
Madison Allen for the said two hundred dollars, with interest
from date thereof; and whereas, the said company has been
dissolved and the road sold by the judgement creditors of said
company, and there being no visible means of the company by
which the said Madison Allen ean recover his said claim or any
part thereof; and whereas, the said Madison Allen proposes to
and hereby releases all claims against the state and company
for the work and labor done on said road, amounting to at
least eight hundred dollars in value: therefore,
1. Be it enacted by the general assembly, That the auditor
igsue his warrant on the treasurer of the state for the sum of
two hundred dollars, with imterest thereon from the fifth day
of January, eighteen hundred and fifty, in favor of the said
Madison Allen, payable out of any funds in the treasury not
otherwise appropriated. |
2. This act shall be in force from its passage.
