Chap. 5.—An ACT to Amend and Re-enact an Act passed March six-
teenth, eighteen hundred and sixty, incorporating the Town of Powell-
ton, in the County of Amherst.
Approved December 21, 1871.
1. Be it enacted by the general assembly of Virginia, That.
the act passed March sixteenth, eighteen hundred and sixty,
entitled “an act to incorporate the town of Powellton, in the
county of Amherst,” be amended and re enacted so as to read
as follows:
“$1. Be it enacted by the general assembly, That the town
of Amherst Court House, in the county of Amherst, as the
same has heretofore been laid off into lots, streets and alleys,
shall be and the same is hereby made a town corporate by the
name of the town of Amherst, and by that name shall have
and exercise the powers conferred upon towns by the fifty-
fourth chapter of the Code of Virginia for eighteen hundred
and sixty, so far as the same is in force; and shall be subject
to and governed by all laws now in force, or which may here-
after pass, for the government of towns containing less than
five thousand inhabitants.
“‘§ 2. There shall be a board of trustees for said town, who
shall compose the council, a majority of whom may constitute
& quorum for the transaction of business; and the following
named persons shall constitute the board of trustees, to wit:
M. H. Wharton, Edgar Whitehead, John J. Shrader, Wm. W.
Thompson, Tinsley L. Allen, B. Brown, Jr., and Leo Daniel,
Jr., to hold their offices until their successors are elected and
qualified according to law.
_ “8 3. The board of trustees shall have power to select, from
their own body, presiding officer, who shall act as mayor of
the town, and appoint a town sergeant, and such other officers
as they may think necessary, together with a police force for
the proper government of the town.”
_ 2. This act shall be in force from its passage.
