Chap. 43.—An ACT to Amend the 27th Section of the 176th Chapter o
the Code of 1860, so as to confer on Commissioners in Chancery th
Power to Administer Oaths.
Approved January 29, 1872.
1. Be it enacted by the general assembly of Virginia, Tha
the twenty-seventh section of chapter one hundred and seventy
six of the Code of Virginia (edition 1860) be amended and re
enacted, so as to read as follows:
“<3 27. In any case in which an oath might be administere
by, or affidavit made before a justice, the same may be done b
or before a notary: public, or commissioner in chancery, or
commissioner appointed by the governor or by a court, or th
clerk of any court, or in case of a survey directed by a com
in a cause therein pending by or before the surveyor directe
to execute said order of: survey. An affidavit may also t
made before any officer of another state or county authorize
by its laws to administer an oath, and shall be deemed dul
f
authenticated if it be subscribed by such officer, and there be
annexed to it a certificate of the clerk or other officer of a
court of record of such state or county, under an official seal,
verifying the genuineness of the signature of the first-men-
tioned officer, and his authority to administer an oath.
2. This act shall be in force from its passage.
