Chap. 83.—An ACT to amend and re-enact Section 5220 of the Code of Virginia,
as heretofore amended, relating to the alteration and vacation of streets and
alleys. [H B 83]

1. Be it enacted by the General Assembly of Virginia, That
section fifty-two hundred and twenty of the Code of Virginia, as
heretofore amended, be amended and re-enacted so as to read as
follows:
Section 5220. Alteration and vacation of streets.——Streets and
alleys so platted and laid out, or which have been platted or laid out
under any plat heretofore recorded, may be altered or vacated in the
manner provided by section nine of chapter one hundred and fifty-
nine of the Acts of the General Assembly of nineteen hundred and
twenty-eight as amended for the alteration and discontinuance of
county roads. In the alteration and vacation of such streets and
alleys in cities and towns, the council thereof shall exercise the same
powers as are granted to and vested in the board of supervisors of
the counties by general law in relation to the discontinuance of
county roads and landings; which shall be in addition to the powers
contained in the charter of any city or town and any powers now had
by such councils under the common law or by statute; provided,
however, that the notice required to be posted by the said section of
the said chapter may be posted on the first day of the term of either
the circuit, corporation, or hustings court, at the courthouse thereof,
and at two public places in the city or town at least five days before
the council appoint the viewers; and the appeal, if any, shall be to
the court before whose front door said notice is posted.
