Chap. 372.—An ACT for the relief of Miller Manual Labor School of Albemarle

Whereas, the funds of Miller Manual Labor School of Albemarle
County were heretofore administered by the State of Virginia through
its second auditor, and the State had full control of investments of
said school; and
Whereas, a large portion of the endowment fund of said school was
invested in certificates of indebtedness of the State of Virginia, bearing
interest partly at six per centum (6%) and partly at five per centum
(5%); and ,
Whereas, in nineteen hundred and twenty-seven the State of
Virginia refunded the certificate of indebtedness held for schools and
colleges in the State, including those held by Miller Manual Labor
School of Albemarle County; and
Whereas, in said refunding a hardship was worked on said Miller
Manual Labor School of Albemarle County causing loss to it of both
a part of the principal of its endowment and income therefrom, which
loss has been partially repaid to said school by appropriation included
in the Refunding Act of nineteen hundred and twenty-seven and by a
further appropriation made by the Act of General Assembly of nine-
teen hundred and thirty; and
Whereas, there still remains a portion of the loss sustained by said
school amounting to fifteen thousand one hundred sixty-eight dollars
and forty-three cents of principal and eleven thousand thirty-five
dollars and eighty-two cents of income, which has not been repaid to
said school; now, therefore,
1. Be it enacted by the General Assembly of Virginia, That
there be, and there is hereby, appropriated out of any moneys in the
State treasury not otherwise appropriated, the sum of twenty-six
thousand, two hundred and four dollars and twenty-five cents for the
relief of the Miller Manual Labor School of Albemarle County on
account of the losses hereinabove mentioned, and the Treasurer of
Virginia is hereby authorized, upon warrant of the Comptroller, to
pay the said sum to the said Miller Manual Labor School of Albe-
marle County.
It is provided, however, that such appropriation shall not be
available for expenditure, either in whole or in part, unless and until
the Governor has certified to the Comptroller in writing that the
payment of the said appropriation will not, in the judgment of the
Governor, create or add to a deficit in the general fund of the State
treasury, during the biennium which ends June thirtieth, nineteen
hundred and forty-two.
